Education Unions: Friedrichs v. California Teachers Association

There are two national teachers unions in the United States today, the National Education Association and the American Federation of Teachers. The NEA was founded in 1857 as a policy-making organization, one that hoped to influence the national debate about schools and schooling. Over the next hundred years, it played a significant role in standardizing teacher training and curriculum. Until the 1960s, the NEA tended to represent the interests of school administrators and educators from colleges and universities.

The AFT, on the other hand, was always much more of a grass-roots teachers’ organization. It was formed in 1897 as the Chicago Teachers Federation, with the explicit aim of improving teachers’ salaries and pensions. Catherine Goggin and Margaret Haley allied the CFT with the labor movement, going so far as to join the American Federation of Labor – an act that horrified everyone who wanted to see teaching as genteel, white-collar employment. At the same time, the union conceived its work in terms of broader social improvement, bettering the lives of the poor and the alienated. By 1916, several local unions had come together to form the AFT. In the 1940s, the AFT began collective bargaining with local school boards, which again horrified some people. Collective bargaining always carries the threat of strikes, and teachers, as servants of the community, were long seen as both too indispensable and too noble to engage in work stoppages. The issue of strikes remains contentious today.

Teacher militancy has waxed and waned over the past 50 years. But many teachers believe that whatever gains they have made — in pay, benefits, job security and working conditions — have come from the efforts of their unions. Today, the NEA and AFT flirt with the idea of merging and have made significant strides towards combining their memberships. University of Chicago Law school study prompts more debate about the effect of unions on education outcome

The truth is that since at least Marbury v. Madison, Courts and Justices have hinted, signaled, begged, and reached out to litigants to bring them issues where one or more justice thinks the law needs to change. On the current Court, few of the Justices have signaled quite as vigorously as Justice Samuel Alito. Alito, a man of firm likes and dislikes, has twice questioned the constitutionality of public-employee contracts. Neither case, however, presented the chance to invalidate them.

Now his moment may have come. In response to Alito’s hints, the issue has landed squarely in the Court’s inbox in the form of a petition for review in a suit against the California Teachers Association. If Alito gets his desired result, it will deal a long-lasting blow to union power—and, perhaps by coincidence, the Democratic Party.
Here’s the issue: Even in union states, public employees cannot be required to join a union. Such a requirement, the Court has said, would violate their First Amendment rights, because that would be the government requiring them to speak and associate against their will. However, state governments can sign agreements with unions designating the union as the official bargaining agent for all employees, members or not. The union then must represent both members and non-members—and representation costs money, in the form of lawyers, economists, researchers, and so forth. Non-members are thus potentially “free riders” who get a service paid for by their fellow workers.

In response, a compromise developed called the “agency-fee” or “fair-share” payment. Requiring objectors to pay for political activities or lobbying would be “compelled political speech,” and violate the First Amendment. However, under the “fair share” system, non-members are charged a fee that excludes these political activities and is designated to cover only the chargeable costs of actual representation—negotiating contracts, administering benefit programs, and helping employees with grievances.

The “fair share” fee is Alito’s current target. In a 1977 case called Abood v. Detroit Board of Education, the Burger Court said the fees do not violate the First Amendment: “Public employees are not basically different from private employees,” the Court said. “[O]n the whole, they have the same sort of skills, the same needs, and seek the same advantages.” The subjects of collective bargaining are the same in either case. Wages and working conditions in the public sector have a political quality, but in their essence were more like the issues that private employers and their workers must negotiate. A state could decide that “exclusive representation” would make for a more orderly workplace; it could also decide to disallow “free riders.” Neither decision violated the First Amendment. “A public employee who believes that a union representing him is urging a course that is unwise as a matter of public policy is not barred from expressing his viewpoint,” the Court said. “Besides voting in accordance with his convictions, every public employee is largely free to express his views, in public or private orally or in writing….” http://www.theatlantic.com/politics/archive/2015/02/the-end-of-public-employee-unions/385690/

The issue is whether public employees can be required to pay fees.

Antonia Domingo summarizes the issues in Friedrichs v. California Teachers Association Heads to the Supreme Court:

While public employees cannot be required to join a union, they can be required to pay fees associated with union representation. In Abood, public school teachers alleged that these “agency shop” or “fair share” agreements amounted to compelled political speech in violation of the First Amendment. The Court disagreed, finding that fair share agreements did not violate the Constitution as long as the non-member fee was limited to collective bargaining and contract administration expenses.

The Court has repeatedly upheld the Abood decision. Supporters argue that because unions are required to represent all employees, whether they choose to join the union or not, it’s only fair to require everyone to pay their share. Otherwise non-members are allowed to free-ride, enjoying the benefits of union representation without contributing. Critics argue that the line the Abood court drew between political and non-political activities is illusory; collective bargaining in the public sector is inherently political. As such, fair share agreements compel speech (or at least the subsidization of speech) and thereby violate objectors’ right to free speech and freedom of association.

In two recent cases, Justice Alito has strongly suggested a willingness to overturn Abood. In Knox v. Service Employees International Union, the Court found that allowing non-members to opt out of increased special fees was not enough; instead non-members only have to pay if they affirmatively opt in. Justice Alito, writing for the majority, said, “free-rider arguments…are generally insufficient to overcome First Amendment objections.” And while the majority opinion in Harris v. Quinn was fairly narrow, Justice Alito went out of his way to state that Abood is an “anomaly.”

Friedrichs v. California Teachers Association

In the Friedrichs petition, the plaintiffs ask the Court to rule on two questions: 1) whether fair share agreements violate the First Amendment; and 2) whether allowing objecting employees to opt out rather than requiring everyone to opt in also violates the First Amendment. Plaintiiffs make the now familiar arguments that ordinary public sector bargaining topics, like teacher tenure and salary, are political. There must be a way to introduce variation into the education system. To the extent that teachers unions hinder the variation in the system, they become a hindrance.

Poverty and effect on children: Ruling In Compton Schools Case: Trauma Could Cause Disability

Characterizing associations between socioeconomic factors and children’s brain development, a team including investigators from nine universities across the country reports correlative links between family income and brain structure. Relationships between the brain and family income were strongest in the lowest end of the economic range — suggesting that interventional policies aimed at these children may have the largest societal impact….

A group of parents sued Compton School district about the trauma caused by poverty.

Cory Turner of NPR wrote in Ruling In Compton Schools Case: Trauma Could Cause Disability:

Students who experience traumatic events while growing up in poor, turbulent neighborhoods could be considered disabled, a federal judge has ruled in a high-profile case involving the Compton, Calif., schools.

The ruling from U.S. District Judge Michael W. Fitzgerald, released on Wednesday, involves a class-action lawsuit filed against the Compton Unified School District. The plaintiffs argued that students who have experienced trauma are entitled to the same services and protections that schools must provide to traditionally disabled students.

The ruling wasn’t a complete win for the plaintiffs and the pro bono firm representing them, Public Counsel. Fitzgerald denied, for now, their request for class-action status because, he said, they hadn’t clearly established what’s known as numerosity.

The plaintiffs estimate that roughly 25 percent of the 22,000 students who attend CUSD have experienced at least two or more “severe traumas.” But the judge wrote that exposure to trauma does not guarantee that a child (1) will suffer “from cognizable trauma-induced disabilities for purposes of the proposed class definition, and (2) have been denied meaningful access to their education.”
It’s an important distinction Fitzgerald is making here. He’s not questioning whether exposure to traumatic events can disable a student. He’s saying that exposure to traumatic events does not guarantee disability. And that raises the bar for the plaintiffs as they try to define the size of their aggrieved class.
The court also refused a request to force Compton’s schools to provide additional, mandatory trauma training for staff. The district currently provides some training, but the plaintiffs argued that the program is insufficient.

Legally, this kind of request is an uphill fight. What’s known as a mandatory injunction — ordering someone to start doing something rather than to stop doing it — comes with a much higher standard, one the judge ruled the plaintiffs did not meet.

What happens next depends on both sides and whether this week’s ruling has encouraged any movement to the middle. A settlement between the plaintiffs and Compton Unified is still possible. If not, the lawsuit will move forward….

Are traumatized students disabled students, entitled to extra help and accommodations in schools? Yes, according to a new lawsuit brought by students and teachers against Compton Unified School District.
The class action lawsuit, which has its first hearing today, alleges that students exposed to trauma through violence, family disruption, discrimination, and extreme stress are disabled under the Americans with Disabilities Act and the Rehabilitation Act and are entitled to the same benefits and accommodations afforded students with more widely recognized learning disabilities.

The Effects of Trauma on Student Learning

The negative impacts of trauma can last throughout a child’s life. Traumatic experiences alter children’s developing brains and impede a child’s ability to learn, according to the lawsuit. Students who experience trauma are more likely to have trouble reading, concentrating, and learning than non-traumatized students. A quarter of all children will experience trauma before the age of 16, Susan Ko of the National Center for Child Traumatic Stress told NPR.

And trauma isn’t hard to come by in Compton. The impoverished, largely minority community south of downtown L.A., is the 13th most deadly neighborhood in Los Angeles County and has murder rates five times the national average. That’s almost Oakland levels of violence.
The lawsuit and associated website detail the struggles many Compton students experience at a young age, from witnessing a murder before they’re ten years old to experiencing years of sexual abuse. Living constantly in fear and stress leaves such students unprepared for pursuing success at school, the suit alleges, yet their needs are most often met with discipline and punishment, rather than extra services. To wit: one member of the class action, Virgil, lived on the roof of his school after becoming homeless. When the school discovered him, he wasn’t offered help. Instead, the school suspended him.

A Systematic Approach

The class action doesn’t seek to match students with individualized educational programs, the typical approach to helping disabled students. Such IEPs would be insufficient in addressing the problem, according to the suit. Rather, the plaintiffs want “implementation of schoolwide trauma-sensitive practices.” That would include extra training for educators, avoidance of punitive discipline measures, and consistent mental health support…..

This government and both parties, has failed to promote the kind of economic development AND policy which creates livable wage jobs. That is why Mc Donalds is popular for more than its dollar menu. They are hiring people. This economy must start producing livable wage jobs and educating kids with skills to fill those jobs. Too bad the government kept the cash sluts and credit crunch weasels like big banks and financial houses fully employed and destroyed the rest of the country.

A T.H. Chan School of Public Health confirms kids are not getting enough time to eat lunch.

Science Daily reported in More time for school lunches equals healthier choices for kids: Children are more likely to eat fruits and vegetables when given at least 25 minutes for lunch, according to a new study the Journal of the Academy of Nutrition and Dietetics:

Elementary and middle school students who are given at least 25 minutes to eat lunch are more likely to choose fruits and consume more of their entrees, milk, and vegetables according to a new study released in the Journal of the Academy of Nutrition and Dietetics.

Each day, over 30 million U.S. students receive a free or discounted meal thanks to the National School Lunch Program. For children from low-income households, these meals can account for almost half of their daily caloric intake, so it is vitally important for schools to find ways to improve student selections and consumption and limit food waste.

This new study examined the association between the length of the lunch period and the food choices and intake of students. Data for the study were collected on six nonconsecutive days throughout the 2011 to 2012 school year as part of the MEALS study, a large, school-based randomized controlled trial. The MEALS study was a collaboration between the nonprofit organization Project Bread and the Harvard T. H. Chan School of Public Health to improve the selection and consumption of healthier school foods. Researchers conducted a plate waste study, which is the gold standard for assessing children’s diets.

Investigators found that when kids have less than 20 minutes of seated time in the cafeteria to eat lunch, they were significantly less likely to select a fruit when compared to peers who had at least 25 minutes to eat lunch (44% vs 57%, respectively). Furthermore, the study found that children with less than 20 minutes to eat lunch consumed 13% less of their entrees, 10% less of their milk, and 12% less of their veggies when compared to students who had at least 25 minutes to eat their lunch. This indicates that kids who were given less time at lunch may be missing out on key components of a healthy diet such as fiber-rich whole grains and calcium.

“Policies that improve the school food environment can have important public health implications in addressing the growing socioeconomic disparities in the prevalence of obesity and in improving the overall nutrient quality of children’s diets,” explained lead investigator Juliana F. W. Cohen, ScD, ScM, Assistant Professor, Department of Health Sciences, Merrimack College, North Andover, MA, and Adjunct Assistant Professor, Department of Nutrition, Harvard T. H. Chan School of Public Health, Boston, MA. “This research suggests that enabling students to have sufficient time to eat their meals can help address this important issue.”

According to the study, another challenge kids face is the minutes they must use during their school lunchtime period for activities besides eating or sitting. Many students spend a considerable amount of time traveling to the cafeteria and then waiting in line to get their lunch. Abstract
Background

There are currently no national standards for school lunch period length and little is known about the association between the amount of time students have to eat and school food selection and consumption.
Objective

Our aim was to examine plate-waste measurements from students in the control arm of the Modifying Eating and Lifestyles at School study (2011 to 2012 school year) to determine the association between amount of time to eat and school meal selection and consumption.

Design
We used a prospective study design using up to six repeated measures among students during the school year.
Participants/setting
One thousand and one students in grades 3 to 8 attending six participating elementary and middle schools in an urban, low-income school district where lunch period lengths varied from 20 to 30 minutes were included.
Main outcome measures
School food selection and consumption were collected using plate-waste methodology.
Statistical analyses performed
Logistic regression and mixed-model analysis of variance was used to examine food selection and consumption.

Results
Compared with meal-component selection when students had at least 25 minutes to eat, students were significantly less likely to select a fruit (44% vs 57%; P<0.0001) when they had <20 minutes to eat. There were no significant differences in entrée, milk, or vegetable selections. Among those who selected a meal component, students with <20 minutes to eat consumed 13% less of their entrée (P<0.0001), 10% less of their milk (P<0.0001), and 12% less of their vegetable (P<0.0001) compared with students who had at least 25 minutes to eat.

Conclusions
During the school year, a substantial number of students had insufficient time to eat, which was associated with significantly decreased entrée, milk, and vegetable consumption compared with students who had more time to eat. School policies that encourage lunches with at least 25 minutes of seated time might reduce food waste and improve dietary intake.

Short lunch periods in schools linked with less healthy eating

Boston, MA ─ Students with less than 20 minutes to eat school lunches consume significantly less of their entrées, milk, and vegetables than those who aren’t as rushed, according to a new study from Harvard T.H. Chan School of Public Health.
The study will appear online Friday, September 11, 2015 in the Journal of the Academy of Nutrition and Dietetics.
“Many children, especially those from low-income families, rely on school meals for up to half their daily energy intake so it is essential that we give students a sufficient amount of time to eat their lunches,” said Juliana Cohen, adjunct assistant professor in the Department of Nutrition at Harvard Chan School, assistant professor in the Department of Health Sciences at Merrimack College, and lead author of the study.
“Every school day the National School Lunch Program helps to feed over 30 million children in 100,000 schools across the U.S., yet little research has been done in this field,” said Eric Rimm, professor of epidemiology and nutrition at Harvard Chan School and the study’s senior author. While recent federal guidelines enhanced the nutritional quality of school lunches, there are no standards regarding lunch period length. Many students have lunch periods that are 20 minutes or less, which can be an insufficient amount of time to eat, according to the authors.
The researchers wanted to examine the effect of lunch period length on students’ food choices and intake. They looked at 1,001 students in six elementary and middle schools, with lunch periods ranging from 20-30 minutes, in a low-income urban school district in Massachusetts, as part of the Modifying Eating and Lifestyles at School (MEALS) study, a collaboration between Project Bread and Harvard Chan School. They analyzed the students’ food selection and consumption by monitoring what was left on their plates at the end of the lunch period.
The researchers found that students with less than 20 minutes to eat lunch consumed 13% less of their entrées, 12% less of their vegetables, and 10% less of their milk than students who had at least 25 minutes to eat. While there were no notable differences between the groups in terms of entrée, milk, or vegetable selections, those with less time to eat were significantly less likely to select a fruit (44% vs. 57%). Also, there was more food waste among groups with less time to eat.
Waiting in serving lines or arriving late to lunch sometimes left children in the study with as little as 10 minutes to actually sit and eat. The researchers acknowledged that while not all schools may be able to lengthen their lunch periods, they could develop strategies to move kids more quickly through lunch lines, such as by adding more serving lines or setting up automated checkout systems.
“We were surprised by some of the results because I expected that with less time children may quickly eat their entrée and drink their milk but throw away all of their fruits and vegetables,” said Rimm. “Not so—we found they got a start on everything, but couldn’t come close to finishing with less time to eat.”
Jaquelyn Jahn, a master’s student in the Department of Social and Behavioral Sciences at Harvard Chan School, was a co-author.
The study was funded by a grant from Project Bread and Arbella Insurance. Cohen was supported by the Nutritional Epidemiology of Cancer Education and Career Development Program (R25 CA 098566).

Stanford School of Medicine study: Brain scans may predict math ability

Jacob Vigdor wrote the interesting Education Next article, Solving America’s Math Problem:

American public schools have made a clear trade-off over the past few decades. With the twin goals of improving the math performance of the average student and promoting equality, it has made the curriculum more accessible. The drawback to exclusive use of this more accessible curriculum can be observed among the nation’s top-performing students, who are either less willing or less able than their predecessors or their high-achieving global peers to follow the career paths in math, science, and engineering that are the key to innovation and job creation. In the name of preparing more of the workforce to take those jobs, we have harmed the skills of those who might have created them. Although there is some evidence of a payoff from this sacrifice, in the form of marginally better performance among average students, some of the strategies used to help these students have in fact backfired…

Not all children are equally prepared to embark on a rigorous math curriculum on the first day of kindergarten, and there are no realistic policy alternatives to change this simple fact. Rather than wish differences among students away, a rational policy for the 21st century will respond to those variations, tailoring lessons to children’s needs. One way of looking at Vigdor’s conclusions is to ask whether high performance preschool programs and early intervention can affect student achievement?

Maggie Fox of NBC News reported in the story, Brain Scans May Predict Math Gains in Children, Study Finds:

Brain scans may be able to predict which kids are likely to improve their math skills in school and which ones are not, and they do it better than IQ or math tests, researchers reported Tuesday.
The researchers have been working with a group of kids who started getting brain scans at the age of 8, and who have followed up with tests into their mid-teens.

To their surprise, the researchers found that certain patterns of brain activity when the kids were not doing anything at all at age 8 predicted how much they would improve their math skills over the years. And these scans did so with far more accuracy than did intelligence tests, reading tests or math tests, they report in the Journal of Neuroscience.

Early numerical proficiency lays the foundation for acquiring quantitative skills essential in today’s technological society. Identification of cognitive and brain markers associated with long-term growth of children’s basic numerical computation abilities is therefore of utmost importance. Previous attempts to relate brain structure and function to numerical competency have focused on behavioral measures from a single time point. Thus, little is known about the brain predictors of individual differences in growth trajectories of numerical abilities. Using a longitudinal design, with multimodal imaging and machine-learning algorithms, we investigated whether brain structure and intrinsic connectivity in early childhood are predictive of 6 year outcomes in numerical abilities spanning childhood and adolescence. Gray matter volume at age 8 in distributed brain regions, including the ventrotemporal occipital cortex (VTOC), the posterior parietal cortex, and the prefrontal cortex, predicted longitudinal gains in numerical, but not reading, abilities. Remarkably, intrinsic connectivity analysis revealed that the strength of functional coupling among these regions also predicted gains in numerical abilities, providing novel evidence for a network of brain regions that works in concert to promote numerical skill acquisition. VTOC connectivity with posterior parietal, anterior temporal, and dorsolateral prefrontal cortices emerged as the most extensive network predicting individual gains in numerical abilities. Crucially, behavioral measures of mathematics, IQ, working memory, and reading did not predict children’s gains in numerical abilities. Our study identifies, for the first time, functional circuits in the human brain that scaffold the development of numerical skills, and highlights potential biomarkers for identifying children at risk for learning difficulties.
SIGNIFICANCE STATEMENT:
Children show substantial individual differences in math abilities and ease of math learning. Early numerical abilities provide the foundation for future academic and professional success in an increasingly technological society. Understanding the early identification of poor math skills has therefore taken on great significance. This work provides important new insights into brain structure and connectivity measures that can predict longitudinal growth of children’s math skills over a 6 year period, and may eventually aid in the early identification of children who might benefit from targeted interventions.

Vinod Menon and his colleagues found that scans of brain structures indicated which childen would be the best math learners over the next six years.

Brain scans from 8-year-old children can predict gains in their mathematical ability over the next six years, according to a new study from the Stanford University School of Medicine.
The research tracked 43 children longitudinally for six years, starting at age 8, and showed that while brain characteristics strongly indicated which children would be the best math learners over the following six years, the children’s performance on math, reading, IQ and memory tests at age 8 did not.

The study, published online Aug. 18 in The Journal of Neuroscience, moves scientists closer to their goal of helping children who struggle to acquire math skills.
“We can identify brain systems that support children’s math skill development over six years in childhood and early adolescence,” said the study’s lead author, Tanya Evans, PhD, postdoctoral scholar in psychiatry and behavioral sciences.

“A long-term goal of this research is to identify children who might benefit most from targeted math intervention at an early age,” said senior author Vinod Menon, PhD, professor of psychiatry and behavioral sciences. “Mathematical skills are crucial in our increasingly technological society, and our new data show which brain features forecast future growth in math abilities.”
At the start of the study, the children received structural and functional magnetic resonance imaging brain scans. None of the kids had neurological or psychiatric disorders, and their intelligence fell in a range considered normal for their age. The scans were conducted while the children lay quietly in the scanner; the scans measured brain structure and intrinsic functional connections between brain regions, and were not tied to performance on any particular math task.

The 8-year-olds also took standardized tests (given outside the scanner) to measure IQ, as well as reading, math and working-memory skills. All of the children returned for at least one follow-up assessment of these skills before age 14, and many children had other additional follow-ups.

Surprising results

The scientists were surprised by the extent and nature of the connections between brain regions that predicted the development of the children’s math skills. Greater volume and connectivity of two areas forecast skill development: the ventro-temporal occipital cortex, which is a brain region that supports visual object perception, and the intra-parietal sulcus, which helps people compare and make judgements about numbers, such as understanding that four is more than three. The strength of these regions’ interconnections with the prefrontal cortex was also predictive. The work identifies a network of brain areas that provides a scaffold for long-term math skill development in children, Menon said.

The 8-year-olds’ initial IQ, reading, working-memory and math scores did not predict long-term learning in math. The lack of predictive ability of standard math tests taken at age 8 suggests that brain features more precisely predict children’s math learning, Evans said. The brain scans capture many different aspects of information processing, thus better forecasting which children will fall behind and which will excel, Menon added.
Just because a child is currently struggling doesn’t necessarily mean he or she will be a poor learner in the future.
“Next, we are investigating how brain connections change over time in children who show large versus small improvements in math skills, and designing new interventions to help children improve their short-term learning and long-term skill acquisition,” Menon said. Although it is still impractical to give brain scans to children on a large scale, the team’s studies provide a baseline understanding of normal development that will help experts develop and validate remediation programs for children with learning disabilities, he noted.
In the meantime, the team’s findings suggest that parents and teachers should encourage children to exercise their mental math muscles. “Just because a child is currently struggling doesn’t necessarily mean he or she will be a poor learner in the future,” Evans said.

Other Stanford co-authors were research assistants John Kochalka, Tricia Ngoon and Sarah Wu; instructor Shaozheng Qin, PhD; and postdoctoral scholar Christian Battista, PhD.

Penn State study: Ethnic students and students of color underrepresented in special education classes

What are learning disabilities (LD)? 

If your child is not doing as well in school as they have the potential to, they may have a learning disability. Having a learning disability means having a normal intelligence but a problem in one or more areas of learning.

A learning disability is a neurobiological disorder; people with LD have brains that learn differently because of differences in brain structure and/or function.  If a person learns differently due to visual, hearing or physical handicaps, mental retardation, emotional disturbance, or environmental, cultural or economic disadvantage, we do not call it a learning disability.

Some people with LD also have attention deficit hyperactivity disorder orADHD.

LDs can affect many different areas:

  • Spoken language—problems in listening and speaking
  • Reading—difficulties decoding or recognizing words or understanding them
  • Written language—problems with writing, spelling, organizing ideas
  • Math—trouble doing arithmetic or understanding basic concepts
  • Reasoning—problems organizing and putting together thoughts
  • Memory—problems remembering facts and instructions
  • Social behavior—difficulties with social judgment, tolerating frustration and making friends
  • Physical coordination—problems with handwriting, manipulating small objects, running and jumping
  • Organization—trouble with managing time and belongings, carrying out a plan
  • Metacognition (thinking about thinking)—problems with knowing, using and monitoring the use of thinking and learning strategies, and learning from mistakes

Why is early diagnosis and treatment so important?

When LDs are not found and treated early on, they tend to snowball.  As kids get more and more behind in school, they may become more and more frustrated, feeling like a failure. Often, self-esteem problems lead to bad behavior and other problems.  High school dropout rates are much higher for students with LDs than for those without [1].   These educational differences, in turn, affect the job and earnings prospects for people with LDs.  When LD is not noticed or not treated, it can cause adult literacy problems.   By identifying LDs early, your child will get the help they need to reach their potential.

How common are learning disabilities?

Educators estimate that between 5 and 10 percent of kids between ages 6 and 17 have learning disabilities [2]. More than half of the kids receiving special education in the United States have LDs [3]Dyslexia is the most common LD; 80 percent of students with LDs have dyslexia [4].

What causes learning disabilities? 

Because there are lots of kinds of learning disabilities, it is hard to diagnose them and pinpoint the causes. LDs seem to be caused by the brain, but the exact causes are not known. Some risk factors are:

         Heredity

         Low birth weight, prematurity, birth trauma or distress

         Stress before or after birth

         Treatment for cancer or leukemia

         Central nervous system infections

         Severe head injuries

          Chronic medical illnesses, like diabetes or asthma

          Poor nutrition

 LDs are not caused by environmental factors, like cultural differences, or bad teaching.

Joy Resmovits reported in the Huffington Post article, More Minority Students Should Be In Special Ed, Study Says:

study released Wednesday, led by Penn State education professor Paul Morgan, suggests that’s the case. Schools have been identifying too few minority students for placement in special education, he claims — in some cases, by a margin as large as 60 percent.

According to a U.S. Education Department study, in fall 2012, 1.08 million black students and 1.24 million Hispanic students ages 6 to 21 were receiving special education services. Of the 5.7 million total special education students, black students comprised 19 percent and Hispanic students 21.8 percent. That same year, 11.3 percent of black students and 8.2 percent of Hispanic students were placed in special education, compared with 8.2 percent of white students.

Morgan bases his conclusion on the assertion that civil rights activists and educators who say too many minority students are in special education have been relying on simple comparisons.

“If general school age population is 14 percent black, you would expect 14 percent of students who are black would be represented in special education,” Morgan said. “But 19 percent of the special ed population is black. That’s been taken as a disparity.”

This reported disparity led the federal government to mandate monitoring of the percentages of minority students placed in special education. School districts found exceeding expected percentages “due to inappropriate identification” are required to allocate 15 percent of a specific funding stream to reducing that number through early intervention, a program to help kids when they’re younger, instead of putting them in separate educational programs for their entire academic lives.

“Children who are minorities are more likely to be exposed to the risk factors that contribute to having a disability: more likely to be exposed to lead, born into poverty, fetal alcohol syndrome,” Morgan said. “You have to take that into account in terms of understanding who is under- or over-represented in special education. Study Finds Minority Students Are Underrepresented in Special Education
Finding Conflicts with Current Federal Legislation and Policy

WASHINGTON, D.C., June 24, 2015—A new federally funded study finds that racial, ethnic, and language minority elementary- and middle-school students are less likely than otherwise similar white, English-speaking children to be identified as having disabilities and, as a result, are disproportionately underrepresented in special education. These findings differ from most prior education research and contrast with current federal legislation and policies. The study was published online today in Educational Researcher, a peer-reviewed journal of the American Educational Research Association.

Authors Paul L. Morgan of the Pennsylvania State University, George Farkas of University of California, Irvine, and Marianne M. Hillemeier, Richard Mattison, Steve Maczuga, Hui Li, and Michael Cook, all of the Pennsylvania State University, found that racial and ethnic minority children are less likely than otherwise similar white, English-speaking children to be identified as disabled across all five of the surveyed disability conditions—learning disabilities, speech or language impairments, intellectual disabilities, other health impairments, or emotional disturbances—and, so, are less likely to receive potentially beneficial special education services. Language minority children are less likely than otherwise similar children from English-speaking homes to be identified as having learning disabilities or speech or language impairments.

Long-standing and ongoing federal legislation and policymaking has attempted to reduce what has been repeatedly reported to be minority overrepresentation in special education. The U.S. Department of Education is currently considering issuing further compliance monitoring guidelines regarding minority overrepresentation.

“Our findings indicate that federal legislation and policies currently designed to reduce minority over-representation in special education may be misdirected,” said Morgan. “These well-intentioned policies instead may be exacerbating the nation’s education inequities by limiting minority children’s access to potentially beneficial special education and related services to which they may be legally entitled.”

The authors analyzed multiyear longitudinal and nationally representative data from the U.S. Department of Education. The analyses extensively controlled for child-, family-, and state-level variables. These included children’s own academic achievement and behavior, whether they were born with low birth weight, family socioeconomic status and access to health insurance, and their state of residence, among other factors.

“Prior studies have mostly looked at simple, unadjusted comparisons between the general population and the special education population, or differences among minority and non-minority students with controls only at the district or school level,” said Morgan. “Yet these studies have often not accounted for minority children’s greater exposure to factors that increase the risk for disabling conditions. In contrast, our study corrects at the child- and family-levels for minority children’s greater exposure to these risk factors, including the strong predictors of academic achievement or behavior for a school-based disability diagnosis.”

The study’s findings indicated that the underrepresentation of minority children was evident throughout elementary and middle school.

Additional results include:

  • African American children have odds of learning disability identification that are 58 percent lower than those of otherwise similar white children. African American children’s odds of identification for speech or language impairments, intellectual disabilities, health impairments, and emotional disturbances are, respectively, 63 percent, 57 percent, 77 percent, and 64 percent lower than otherwise similar white children.
  • Hispanic children have odds of learning disability, speech or language impairments, or other health impairments that are, respectively, 29 percent, 33 percent, and 73 percent lower than otherwise similar white children.
  • Children from non-English-speaking households have odds of learning disabilities as well as speech or language impairment identification that are, respectively, 28 percent and 40 percent lower than otherwise similar children from English-speaking households.
  • Children from families without health insurance are less likely to be identified as having speech or language impairments.
  • Children from families with lower levels of education and income are less likely to be identified as having other health impairments.

“This underrepresentation may result from teachers, school psychologists, and other education professionals responding differently to white, English-speaking children and their parents,” said Morgan. “Education professionals should be attentive to cultural and language barriers that may keep minority children with disabilities from being appropriately identified and treated.”

“Untreated disabilities increase children’s risk for many adversities, including persistent academic and behavioral difficulties in school,” Morgan said. “As a matter of social justice, we should work to ensure that all children with disabilities, regardless of their race, ethnicity, or language use, receive the care they need.”

Everyone is focused on race, social class may be as or more important

Many educators have long recognized that the impact of social class affects both education achievement and life chances after completion of education. There are two impacts from diversity; one is to broaden the life experience of the privileged and to raise the expectations of the disadvantaged. Social class matters in not only other societies, but this one as well.
A few years back, the New York Times did a series about social class in America. That series is still relevant. Sarah Garland wrote in the Atlantic article, When Class Became More Important to a Child’s Education Than Race:

On a weekday afternoon in July, Jessica Klaitman pulled her 16-month-old daughter Hannah out of a stroller in the lobby of the New York Kids Club, a “child-enrichment center” with four classrooms, a dance studio, and gym space in Brooklyn Heights, N.Y.

Hannah was sleepy after a nap, but her face lit up as she was let loose with several other toddlers and their nannies. She grabbed some blocks and then headed to a table stocked with piles of a pink, play-dough-like sculpting material. For 45 minutes, the children wandered around wielding dolls and blocks, grabbing at each others’ toys and taking turns on a miniature slide. When time was up, they sang along with the “Clean-Up Song” and helped put away the mess.

A drop-in class at the New York Kids Club costs about $47, according to an employee. Hannah’s playgroup that day was free, but only because Klaitman, 40, and her husband, Jordan Small, 39, have enrolled their three children in package deals for classes in karate and preschool–which run about $650 per child for 17 once-a-week sessions. Klaitman estimates she’s dropped thousands of dollars at the club over the years, not to mention what she spends on the private preschool her oldest son attends, additional classes in Spanish and music elsewhere, and the family’s museum memberships.

The Klaitman-Smalls’ considerable investment in their children is becoming the norm for families like theirs who are in the top tiers of the country’s income distribution. The resources the affluent are pouring into their children are also driving a growing divide between academic outcomes of the children of the well-to-do and those of everyone else’s kids. That widening academic divide means that kids who are born poor and kids who are born rich are increasingly likely to stay that way once they reach adulthood….

Researchers say the expanding class gap in education is likely a byproduct of the country’s widening income inequality. There’s been an explosion in spending by well-to-do parents on their children: The amount has more than doubled in the last 30 years, according to work by Columbia University School of Social Work researchers Neeraj Kaushal and Jane Waldfogel and Katherine Magnuson of the University of Wisconsin.

Parents in the top quintile of income in the U.S. (households earning at least $102,000 in 2011, according to census data compiled by the Tax Policy Institute, a nonprofit research group) now spend more than double what parents in the second quintile (earning at least $62,000) spend on trips for their children-about $2,000 per year compared with $800, the Kaushal study found. When his oldest son reached school age, Michael Petrilli faced a dilemma known to many middle-class parents living in cities they helped gentrify: Should the family flee to the homogenous suburbs for excellent schools or stay urban for diverse but often struggling schools?

Petrilli, who lived in Takoma Park with his wife and two sons, was torn, but he knew more than most people about the choice before him. Petrilli is an education expert, a former official in the Education Department under George W. Bush and executive vice president at the Thomas B. Fordham Institute, a right-leaning education think tank.
He set out to learn as much as he could about the risks and benefits of socioeconomically diverse schools, where at least 20 percent of students are eligible for the federal free or reduced-price lunch program. And then he wrote about it….

Petrilli said he wanted his son to have friends from all backgrounds because he believes that cultural literacy will prepare him for success in a global society.

But he worried that his son might get lost in a classroom that has a high percentage of poor children, that teachers would be focused on the struggling children and have less time for their more privileged peers.
As Petrilli points out in the book, this dilemma doesn’t exist for most white, middle-class families. The vast majority — 87 percent — of white students attend majority white schools, Petrilli says, even though they make up just about 50 percent of the public school population.

And even in urban areas with significant African American and Latino populations, neighborhood schools still tend to be segregated by class, if not by race. In the Washington region, less than 3 percent of white public school students attend schools where poor children are the majority, according to Petrilli.

Often, schools are segregated by both race and class. Class identification is very important in education because of class and peer support for education achievement and the value placed on education by social class groups. Moi does not condemn Mr. Petrilli for doing what is best for his family because when the rubber meets the road that is what parents are supposed to do. His family’s situation is just an example of the intersection of race and class in education.

Institute of Education Sciences study: States lack capacity to improve failing schools

There is no magic bullet or “Holy Grail” in education. There is only what works to produce academic achievement in each population of children. That is why school choice is so important.

Lyndsey Layton wrote in the Washington Post article, Most states lacked expertise to improve worst schools:

The Obama administration handed out more than $3 billion to the states and the District of Columbia to help them turn around their worst-performing schools as part of the federal stimulus spending that took place after the 2008 recession.

But most states lacked the capacity to improve those schools, according to a new analysis by federal researchers.

Although turning around the worst schools was a priority for nearly every state, most did not have the staff, technology and expertise to pull those schools out of the bottom rankings, according to a brief released Tuesday by the Institute of Education Sciences, the research arm of the U.S. Education Department.

With funds allocated by Congress under the American Recovery and Reinvestment Act of 2009, the Obama administration spent $3.5 million on School Improvement Grants to states, directing them to focus the money on their lowest-performing schools.

School Improvement Grants had been part of No Child Left Behind, the 2002 federal education law. But stimulus spending increased the budget for the grants sixfold.

Under the Obama administration, schools could receive up to $2 million annually for three years. The money was divided among the states and D.C. according a federal formula. About 1,500 schools received grants.

Any school accepting a grant had to agree to adopt one of four strategies favored by the administration: Replace the principal and at least 50 percent of the staff; close the school and enroll students in another, better-performing school; close the school and reopen it as a charter school; or transform the school through new instructional strategies and other techniques.

While 84 percent of states told the researchers that improving the worst schools was a top priority, 58 percent said it was one of the most difficult tasks to accomplish. One objective of the U.S. Department of Education’s (ED) School Improvement Grants (SIG) and Race to the Top (RTT) program is to help states enhance their capacity to support the turnaround of low-performing schools. This capacity may be important, given how difficult it is to produce substantial and sustained achievement gains in low-performing schools. There is limited existing research on the extent to which states have the capacity to support school turnaround and are pursuing strategies to enhance that capacity. This brief documents states’ capacity to support school turnaround as of spring 2012 and spring 2013. It examines capacity issues for all states and for those that reported both prioritizing turnaround and having significant gaps in expertise to support it. Key findings, based on interviews with administrators from 49 states and the District of Columbia, include the following:

• More than 80 percent of states made turning around low-performing schools a high priority, but at least 50 percent found it very difficult to turn around low-performing schools.
• 38 states (76 percent) reported significant gaps in expertise for supporting school turnaround in 2012, and that number increased to 40 (80 percent) in 2013.
• More than 85 percent of states reported using strategies to enhance their capacity to support school turnaround, with the use of intermediaries decreasing over time and the use of organizational or administrative structures increasing over time.
• States that reported both prioritizing school turnaround and having significant gaps in expertise to support it were no more likely to report using intermediaries than other states but all 21 of these states reported having at least one organizational or administrative structure compared with 86 percent (25 of 29) of all other states.

The brief resulted from collaboration between experts at the American Institutes for Research (AIR) and Mathematica Policy Research. It is the fourth brief in a large-scale evaluation of School Improvement Grant (SIG) and Race to the Top (RTT) programs

“Improving low-performing schools does not happen overnight,” said Courtney Tanenbaum, a senior researcher at AIR. “Turning them around is a complex and challenging endeavor. So it is not surprising that states would feel a need for more support in this area.”
Through structured telephone interviews with administrators in 49 states and the District of Columbia, the study found:

• More than 80 percent of states made turning around low-performing schools a high priority, but at least 50 percent of all states found turnaround very difficult.
• Thirty-eight states (76 percent) reported significant gaps in expertise for supporting school turnaround in 2012, and that number increased to 40 states (80 percent) in 2013.
• More than 85 percent of states reported using strategies to enhance their capacity to support school turnaround. The use of intermediaries decreased over time, and the use of organizational or administrative structures increased over time.
• Twenty-one states reported prioritizing school turnaround and having significant gaps in expertise to support it. Although these states were no more likely to use intermediaries than other states, all 21 reported having at least one organizational or administrative structure to improve their capacity to support turnaround, compared with 86 percent (25 of 29) of other states.

“States can play an important role in tackling the challenges of school turnaround, for example, by arranging external support to address barriers to improvement,” said Susanne James-Burdumy, Mathematica senior fellow and director of the evaluation. “For this reason, SIG and RTT provided resources to improve state capacity to support turnaround, but concerns linger about state capacity to continue that support once SIG and RTT funding runs out. Our brief sheds light on the specific capacity constraints states are facing and where additional supports could be warranted.”

Cornell University study: Women preferred for tenure-track STEM positions

Many educators have long recognized that the impact of social class affects both education achievement and life chances after completion of education. There are two impacts from diversity, one is to broaden the life experience of the privileged and to raise the expectations of the disadvantaged. Social class matters in not only other societies, but this one as well.
A few years back, the New York Times did a series about social class in America. That series is still relevant. Janny Scott and David Leonhardt’s overview, Shadowy Lines That Still Divide describes the challenges faced by schools trying to overcome the disparity in education. Social class and background may not only affect an individual student’s choice of major, but their completion of college in that major. Nick De Santis reported in the Chronicle of Higher Education article, Report Examines College Students’ Attrition From STEM Majors:

Twenty-eight percent of bachelor’s-degree students who began their postsecondary education in the 2003-4 academic year chose a major in science, technology, engineering, or mathematics at some point within six years, but 48 percent of students who entered those fields during that period had left them by the spring of 2009, according to a report released on Tuesday by the National Center for Education Statistics, the U.S. Education Department’s statistical arm.
The report, which addresses attrition from the so-called STEM fields, also includes information on students pursuing associate degrees. It says that 20 percent of such students had chosen a STEM major within that six-year period and notes that 69 percent of them had left the STEM fields by the spring of 2009.
Of the students who left STEM fields, the report says, roughly half switched their major to a non-STEM field, and the rest left college without earning a degree or certificate. The report notes that fields such as the humanities and education experienced higher levels of attrition than did the STEM disciplines.
The report identifies several factors associated with a higher probability of switching out of STEM majors, such as taking lighter STEM course loads or less-challenging math classes in the first year, and earning lower grades in STEM courses than in others….

A Cornell University study found that should women remain in STEM programs they might be preferred for tenure-track faculty positions.

Allie Bidwell reported in the U.S. News article, Report: Faculty Prefer Women for Tenure-Track STEM Positions:

In a nationwide study from the Cornell Institute for Women in Science – published Monday in the Proceedings of the National Academy of Sciences – professors Wendy Williams and Stephen Ceci found tenure-track faculty in engineering, economics, biology and psychology fields generally favored hiring female candidates over otherwise identical male candidates by a 2-to-1 margin. A series of five experiments were conducted on 873 faculty members at 371 colleges and universities from all 50 states and the District of Columbia.

The stark underrepresentation of women in math-intensive STEM fields, the authors suggest, is more a result of obstacles at the front end that prevent women from applying for faculty positions in the first place. Meanwhile, it appears gender diversity has become more valued among college faculty…

In the first experiment, the researchers presented the faculty decision-makers with two highly qualified candidates who were equal other than their gender, as well as a third, slightly less-qualified male candidate. Overall, 67.3 percent of faculty ranked the female candidate first, which was consistent across varying lifestyles such as being married or single or having or not having young children.

But other variations showed some lifestyle choices may influence how hiring decisions are made.

A second experiment presented male and female candidates with nonmatching lifestyles: a divorced mother with two young children and an absent ex-spouse competing with a married father with two young children and a stay-at-home wife, for example. In that scenario, female faculty strongly preferred divorced mothers over married fathers (71.4 percent compared with 28.6 percent), while male faculty showed the opposite trend, just not as strongly (42.9 percent compared with 57.1 percent).

When focusing on whether candidates took parental leave during graduate school, male faculty members by a 2-1 margin preferred female candidates who took a one-year leave over those who did not. Male and female faculty showed no preference between male candidates who did or did not take leave, but female faculty members tended to prefer female candidates who did not take leave.

“Women’s perceptions that an extended maternity leave will cause them to be viewed as less committed to their profession may influence some women to opt out entirely,” the study said.
A fourth experiment was conducted to determine whether faculty decision-makers would still rank female candidates higher if they were presented with full CVs, as opposed to narrative summaries with notes from a search committee, and the researchers found similar results. Finally, a fifth experiment presented faculty with one applicant to rate – to see if they would still prefer a female if they couldn’t choose among men and women – and found the faculty members still favored female applicants….

Still, other studies have found evidence of gender bias in STEM related fields.
“When looking at gender bias in science, it’s very important to look at what particular context,” says David Miller, a graduate student at Northwestern University who has studied gender representation in STEM. “The fact there was a preference for female candidates is perhaps not that surprising if you consider many of these faculty hiring boards are looking to diversify their group of faculty. There are other contexts that do show gender bias against females.”

In 2012, Corinne Moss-Racusin, an assistant professor of psychology at Skidmore College, published research that showed strong gender bias in hiring for a lab manager position. Moss-Racusin and her colleagues asked more than 100 STEM professors to assess fictitious resumes that only differed in the name of the applicant (John vs. Jennifer). Despite being otherwise identical in qualifications, the female applicant was seen as less competent – and the scientists were less willing to mentor the candidate or hire her for the position, and recommended paying her a lower salary.

Williams and Ceci argue in an appendix to their study that Moss-Racusin’s research differs from their own because it focuses on biases against female undergraduate students, rather than those who have already earned a doctorate. The underrepresentation of women in academic science is typically attributed, both in scientific literature and in the media, to sexist hiring. Here we report five hiring experiments in which faculty evaluated hypothetical female and male applicants, using systematically varied profiles disguising identical scholarship, for assistant professorships in biology, engineering, economics, and psychology. Contrary to prevailing assumptions, men and women faculty members from all four fields preferred female applicants 2:1 over identically qualified males with matching lifestyles (single, married, divorced), with the exception of male economists, who showed no gender preference. Comparing different lifestyles revealed that women preferred divorced mothers to married fathers and that men preferred mothers who took parental leaves to mothers who did not. Our findings, supported by real-world academic hiring data, suggest advantages for women launching academic science careers.

Abstract

National randomized experiments and validation studies were conducted on 873 tenure-track faculty (439 male, 434 female) from biology, engineering, economics, and psychology at 371 universities/colleges from 50 US states and the District of Columbia. In the main experiment, 363 faculty members evaluated narrative summaries describing hypothetical female and male applicants for tenure-track assistant professorships who shared the same lifestyle (e.g., single without children, married with children). Applicants’ profiles were systematically varied to disguise identically rated scholarship; profiles were counterbalanced by gender across faculty to enable between-faculty comparisons of hiring preferences for identically qualified women versus men. Results revealed a 2:1 preference for women by faculty of both genders across both math-intensive and non–math-intensive fields, with the single exception of male economists, who showed no gender preference. Results were replicated using weighted analyses to control for national sample characteristics. In follow-up experiments, 144 faculty evaluated competing applicants with differing lifestyles (e.g., divorced mother vs. married father), and 204 faculty compared same-gender candidates with children, but differing in whether they took 1-y-parental leaves in graduate school. Women preferred divorced mothers to married fathers; men preferred mothers who took leaves to mothers who did not. In two validation studies, 35 engineering faculty provided rankings using full curricula vitae instead of narratives, and 127 faculty rated one applicant rather than choosing from a mixed-gender group; the same preference for women was shown by faculty of both genders. These results suggest it is a propitious time for women launching careers in academic science. Women preferred 2:1 over men for STEM faculty positions

For decades, sexism in higher education has been blamed for blocking women from landing academic positions in STEM (science, technology, engineering and mathematics) fields.
But a new study by Cornell psychologists suggests that era has ended, finding in experiments with professors from 371 colleges and universities across the United States that science and engineering faculty preferred women two-to-one over identically qualified male candidates for assistant professor positions.

Published online April 13 in the Proceedings of the National Academy of Sciences, the paper, “National Hiring Experiments Reveal 2:1 Faculty Preference For Women on STEM Tenure Track,” by Wendy M. Williams, professor of human development, and Stephen J. Ceci, the Helen L. Carr Professor of Developmental Psychology, both in Cornell’s College of Human Ecology, argues that the academic job market has never been better for women Ph.D.s in math-intensive fields.

Williams and Ceci conducted five randomized controlled experiments with 873 tenure-track faculty in all 50 U.S. states to assess gender bias. In three studies, faculty evaluated narrative summaries describing hypothetical male and female applicants for tenure-track assistant professorships in biology, economics, engineering and psychology. In a fourth experiment, engineering faculty evaluated full CVs instead of narratives, and in a fifth study, faculty evaluated one candidate (either a man or identically qualified woman) without comparison to an opposite-gender candidate. Candidates’ personalities were systematically varied to disguise the hypotheses.

The only evidence of bias the authors discovered was in favor of women; faculty in all four disciplines preferred female applicants to male candidates, with the exception of male economists, who showed no gender preference.

In some conditions, Williams and Ceci also matched applicants on job qualifications and lifestyle characteristics such as marital and parental status and used contrasting lifestyles in others. They examined attributes such as being a single mother, having a stay-at-home partner and past choices about taking parental leave. These experiments revealed that female faculty preferred divorced mothers over married fathers and male faculty preferred mothers who took leaves over mothers who did not.

“Efforts to combat formerly widespread sexism in hiring appear to have succeeded,” Williams and Ceci write. “Our data suggest it is an auspicious time to be a talented woman launching a STEM tenure-track academic career, contrary to findings from earlier investigations alleging bias, none of which examined faculty hiring bias against female applicants in the disciplines in which women are underrepresented. Our research suggests that the mechanism resulting in women’s underrepresentation today may lie more on the supply side, in women’s decisions not to apply, than on the demand side, in anti-female bias in hiring.”

“Women struggling with the quandary of how to remain in the academy but still have extended leave time with new children, and debating having children in graduate school versus waiting until tenure, may be heartened to learn that female candidates depicted as taking one-year parental leaves in our study were ranked higher by predominantly male voting faculties than identically qualified mothers who did not take leaves,” the authors continue.

Real-world academic hiring data validate the findings, too. The paper notes recent national census-type studies showing that female Ph.D.s are disproportionately less likely to apply for tenure-track positions, yet when they do they are more likely to be hired, in some science fields approaching the two-to-one ratio revealed by Williams and Ceci.
The authors note that greater gender awareness in the academy and the retirement of older, more sexist faculty may have gradually led to a more welcoming environment for women in academic science.

Despite these successes, Williams and Ceci acknowledge that women face other barriers to entry during adolescence and young adulthood, in graduate school and later in their careers as academic scientists, particularly when balancing motherhood and careers. They are currently analyzing national data on mentorship, authorship decisions and tenure advice, all as a function of gender, to better understand women and men’s decisions to apply to, and persist in, academic science. The Cornell study points to the need for good science education to prepare a diverse population for opportunities. K-12 education must not only prepare students by teaching basic skills, but they must prepare students for training after high school, either college or vocational. There should not only be a solid education foundation established in K-12, but there must be more accurate evaluation of whether individual students are “college ready.”

University of Illinois report: Distinctions between academic versus intellectual goals for young children

The standards require that children learn specific facts and skills — such as naming the letters — at specified ages. This has led to more teacher-directed “lessons,” less play-based activity and curriculum, and more rote teaching and learning as children try to learn what is required.
Yet decades of research and theory tell us that young children learn best through active learning experiences within a meaningful context. Children develop at individual rates, learn in unique ways, and come from a wide variety of cultural and language backgrounds. It is not possible to teach skills in isolation or to mandate what any young child will understand at any particular time.

2. Current policies support an over-emphasis on testing and assessment at the expense of all other aspects of early childhood education.
Already strapped for time and money, schools turn valuable attention and resources toward preparing teachers to administer and score tests and assessments rather than meet the needs of the whole child. As teachers strive to raise test scores, they increasingly depend on scripted curricula designed to teach what is on the tests. We know, however, that children learn best when skilled and responsive teachers observe them closely and provide curriculum tailored to meet each child’s needs. Standardized tests of any type do not have a place in early childhood education, and should not be used for making decisions about young children or their programs. Individualized assessments of each child’s abilities, interests and needs provide teachers with the information they require to individualize teaching and learning.

3. Cumulatively, current policies are promoting a de-professionalization of teachers.
The growing focus on standards and testing disregards the strong knowledge base early childhood teachers have. It undermines teachers’ ability to teach using their professional expertise, to provide the optimal, individualized learning opportunities they know how to offer. Instead, teachers are often required to follow prescribed curricula taught in lock step to all children. At the same time, more teachers without strong backgrounds in early childhood education are being hired, increasing the dependence of teachers on standardized tests and scripted curricula.

As one of their first initiatives, Defending the Early Years (DEY) is conducting a national survey of early childhood professionals — teachers, child care workers, program and school directors — on the ways their work is currently affected by federal, state, and local policies, such as standards for learning and mandated tests. Responses are anonymous. The data are being collected and tabulated by an independent opinion research firm. The debate about appropriate curriculum for young children generally centers on two options: free play and basic activities vs. straight academics (which is what many kindergartens across the country have adopted, often reducing or eliminating time for play).

A new report, “Lively Minds: Distinctions between academic versus intellectual goals for young children,” offers a new way to look at what is appropriate in early childhood education.
The report was written by Lilian G. Katz, professor emerita of early childhood education at the University of Illinois at Urbana-Champaign, where she is on the staff of the Clearinghouse on Early Education and Parenting. She is past president of the National Association for the Education of Young Children and the first president of the Illinois Association for the Education of Young Children. Katz is currently the editor of the online peer-reviewed trilingual early childhood journal Early Childhood Research & Practice, and she is the author of more than 100 publications about early childhood education, teacher education, child development and the parenting of young children.

In the wake of the Common Core academic push down on America’s kindergartners, a new report by Lilian G. Katz argues that excessive and early formal instruction can be damaging to our youngest children in the long term. Today, Defending the Early Years is proud to release Lively Minds: Distinctions between academic versus intellectual goals for young children.

Author Lillian G. Katz, Professor Emerita of Early Childhood Education at the University of Illinois, argues that the common sense notion that “earlier is better” is not supported by longitudinal studies of the effects of different kinds of preschool curriculum models. Furthermore, her report maintains that a narrow academic curriculum does not recognize the innate inquisitiveness of young children and ultimately fails to address the way they learn.
“Young children enter the classroom with lively minds–with innate intellectual dispositions toward making sense of their own experience, toward reasoning, predicting, analyzing, questioning and learning,” says Dr. Katz.

“But in our attempt to quantify and verify children’s learning, we impose premature formal instruction on kids at the expense of cultivating their true intellectual capabilities – and ultimately their optimal learning.”

While the report concludes that an appropriate curriculum for young children is one that focuses on supporting children’s in-born intellectual dispositions, some basic academic instruction in early years is needed. “Academic skills become necessary for students to understand and report on their own authentic investigations,” explains Katz. “These skills can then serve as a means to the greater end of fostering and advancing children’s intellectual capabilities.”

American Academy of Pediatrics opposes drug testing in schools

Substance abuse is often a manifestation of other problems that child has either at home or poor social relations including low self esteem. 1. Physical and health warning signs of drug abuse
• Eyes that are bloodshot or pupils that are smaller or larger than normal.
• Frequent nosebleeds–could be related to snorted drugs (meth or cocaine).
• Changes in appetite or sleep patterns. Sudden weight loss or weight gain.
• Seizures without a history of epilepsy.
• Deterioration in personal grooming or physical appearance.
• Injuries/accidents and person won’t or can’t tell you how they got hurt.
• Unusual smells on breath, body, or clothing.
• Shakes, tremors, incoherent or slurred speech, impaired or unstable coordination.

2. Behavioral signs of drug abuse
• Drop in attendance and performance at work or school; loss of interest in extracurricular activities, hobbies, sports or exercise; decreased motivation.
• Complaints from co-workers, supervisors, teachers or classmates.
• Unusual or unexplained need for money or financial problems; borrowing or stealing; missing money or valuables.
• Silent, withdrawn, engaging in secretive or suspicious behaviors.
• Sudden change in relationships, friends, favorite hangouts, and hobbies.
• Frequently getting into trouble (arguments, fights, accidents, illegal activities).

3. Psychological warning signs of drug abuse
• Unexplained change in personality or attitude.
• Sudden mood changes, irritability, angry outbursts or laughing at nothing.
• Periods of unusual hyperactivity or agitation.
• Lack of motivation; inability to focus, appearing lethargic or “spaced out.”
• Appearing fearful, withdrawn, anxious, or paranoid, with no apparent reason.
Signs and symptoms of Drug Dependence:
Drug dependence involves all the symptoms of drug abuse, but also involves another element: physical dependence.
1. Tolerance: Tolerance means that, over time, you need more drugs to feel the same effects. Do they use more drugs now than they used before? Do they use more drugs than other people without showing obvious signs of intoxication?
2. Withdrawal: As the effect of the drugs wear off, the person may experience withdrawal symptoms: anxiety or jumpiness; shakiness or trembling; sweating, nausea and vomiting; insomnia; depression; irritability; fatigue or loss of appetite and headaches. Do they use drugs to steady the nerves, stop the shakes in the morning? Drug use to relieve or avoid withdrawal symptoms is a sign of addiction.
In severe cases, withdrawal from drugs can be life-threatening and involve hallucinations, confusion, seizures, fever, and agitation. These symptoms can be dangerous and should be managed by a physician specifically trained and experienced in dealing with addiction.
3. Loss of Control: Using more drugs than they wanted to, for longer than they intended, or despite telling themselves that they wouldn’t do it this time.
4. Desire to Stop, But Can’t: They have a persistent desire to cut down or stop their drug use, but all efforts to stop and stay stopped, have been unsuccessful.
5. Neglecting Other Activities: They are spending less time on activities that used to be important to them (hanging out with family and friends, exercising or going to the gym, pursuing hobbies or other interests) because of the use of drugs.
6. Drugs Take Up Greater Time, Energy and Focus: They spend a lot of time using drugs, thinking about it, or recovering from its effects. They have few, if any, interests, social or community involvements that don’t revolve around the use of drugs.
7. Continued Use Despite Negative Consequences: They continue to use drugs even though they know it’s causing problems. As an example, person may realize that their drug use is interfering with ability to do their job, is damaging their marriage, making problems worse, or causing health problems, but they continue to use…. https://ncadd.org/learn-about-drugs/signs-and-symptoms

Remember, these are very general signs, specific drugs, narcotics, and other substances may have different signs, it is important to know the specific signs.

Kathryn Doyle of Reuters wrote in Experts caution against random drug testing in schools:

Schools should not be using random drug tests to catch or deter drug abusers, the American Academy of Pediatrics advises in an updated policy statement.

The Academy recommends against school-based “suspicionless” drug testing in the new issue of the journal Pediatrics.

Identifying kids who use drugs and entering them into treatment programs should be a top priority, but there is little evidence that random drug testing helps accomplish this, said Dr. Sharon Levy, director of the adolescent substance abuse program at Boston Children’s Hospital and lead author of the new policy statement…

Scientifically, the best way to test the value of random drug tests would be to put some kids into a drug testing program and others not, in a single school, but practically, that is difficult to accomplish. Instead, researchers have compared schools with drug testing programs to similar schools without them – and found mixed results.

One study did find a short-term reduction in kids’ self-reported drug use at a school with random testing, but the kids were followed for a relatively short period and reductions in use applied only to the drugs included in the testing. This is a problem since most drug testing panels do not include alcohol, Levy said.
“It’s possible that you do get some prevention out of these programs, but on the other hand it seems very expensive, very invasive, and has pretty limited results,” she said.

Adolescent drug use is usually sporadic, so even a kid who does use illegal substances may easily pass a random annual test and then feel comfortable to use freely for the rest of the year, she said.

Drug tests can result in false positives, and even a true positive says nothing about frequency or quantity of drug use, according to Ken C. Winters of the psychiatry department at the University of Minnesota Medical School in Minneapolis, who is not in the AAP.

Drug testing can be useful for pediatricians and other health care providers to assess substance use or mental health disorders in adolescents, but random drug testing in schools is a controversial approach not recommended by the American Academy of Pediatrics (AAP).

In an updated policy statement and technical report, “Adolescent Drug Testing Policies in Schools,” in the April 2015 Pediatrics (published online March 30), the AAP encourages and supports the efforts of schools to identify and address student substance abuse, but recommends against the use of school-based drug testing programs, often called suspicionless or random drug testing.

Proponents of random drug testing refer to potential advantages such as students avoiding drug use because of the negative consequences associated with having a positive drug test results, while opponents of random drug testing agree that the disadvantages are much greater, and can include deterioration in the student-school relationship, confidentiality of students’ medical records, and mistakes in interpreting drug tests that can result in false-positive results.

The AAP recommends against the use of school-based drug testing programs because of limited evidence of efficacy and potential risks associated with this procedure. Pediatricians support the development of effective substance abuse services in schools, along with appropriate referral policies in place for adolescents struggling with substance abuse disorders.

Why test teenagers at all?

Teens are especially vulnerable to drug abuse, when the brain and body are still developing. Most teens do not use drugs, but for those who do, it can lead to a wide range of adverse effects on the brain, the body, behavior and health.
Short term: Even a single use of an intoxicating drug can affect a person’s judgment and decisonmaking—resulting in accidents, poor performance in a school or sports activity, unplanned risky behavior, and the risk of overdosing.
Long term: Repeated drug abuse can lead to serious problems, such as poor academic outcomes, mood changes (depending on the drug: depression, anxiety, paranoia, psychosis), and social or family problems caused or worsened by drugs.
Repeated drug use can also lead to the disease of addiction. Studies show that the earlier a teen begins using drugs, the more likely he or she will develop a substance abuse problem or addiction. Conversely, if teens stay away from drugs while in high school, they are less likely to develop a substance abuse problem later in life….
Is random drug testing of students legal?
In June 2002, the U.S. Supreme Court broadened the authority of public schools to test students for illegal drugs. Voting 5 to 4 in Pottawatomie County v. Earls, the court ruled to allow random drug tests for all middle and high school students participating in competitive extracurricular activities. The ruling greatly expanded the scope of school drug testing, which previously had been allowed only for student athletes.
Just because the U.S. Supreme Court said student drug testing for adolescents in competitive extracurricular activities is constitutional, does that mean it is legal in my city or state?
A school or school district that is interested in adopting a student drug testing program should seek legal expertise so that it complies with all federal, state, and local laws. Individual state constitutions may dictate different legal thresholds for allowing student drug testing.
