Missouri high school to drug test students

Fox News reports in the story, Missouri high school reportedly to use hair samples for random drug tests:

Beginning in the 2013-2014 school year, students at Rockhurst High School in Kansas City will be mandated to undergo random drug testing by submitting roughly 60 strands of hair to a staff member at the 1,000-student school, KSHB.com reports.

Using a company called Psychemedics, officials at the Jesuit school said students will be tested for a variety of substances over the previous 90 days, including cocaine, PCP, opiates, methamphetamine, marijuana and binge alcohol.

Our point is, if we do encounter a student who has made some bad decisions with drugs or alcohol, we will be able to intervene, get the parents involved, get him help if necessary, and then help him get back on a path of better decision making, healthier choices for his life,” Rockhurst Principal Greg Harkness told the website.

If a student tests positive for any substance, according to the new policy, a guidance counselor will be notified. The counselor will then notify the student’s parents to determine how to best help the child.

The student would then be given 90 days to be drug-free, with no notification sent to administrative personnel. The incident would only be noted in the student’s guidance file, which would later be destroyed upon graduation and will not be sent to colleges or universities. The document would only become public if subpoenaed, the website reports.

Why test teenagers at all?

Teens are especially vulnerable to drug abuse, when the brain and body are still developing. Most teens do not use drugs, but for those who do, it can lead to a wide range of adverse effects on the brain, the body, behavior and health.

Short term: Even a single use of an intoxicating drug can affect a person’s judgment and decisonmaking—resulting in accidents, poor performance in a school or sports activity, unplanned risky behavior, and the risk of overdosing.

Long term: Repeated drug abuse can lead to serious problems, such as poor academic outcomes, mood changes (depending on the drug: depression, anxiety, paranoia, psychosis), and social or family problems caused or worsened by drugs.

Repeated drug use can also lead to the disease of addiction. Studies show that the earlier a teen begins using drugs, the more likely he or she will develop a substance abuse problem or addiction. Conversely, if teens stay away from drugs while in high school, they are less likely to develop a substance abuse problem later in life….

Is random drug testing of students legal?

In June 2002, the U.S. Supreme Court broadened the authority of public schools to test students for illegal drugs. Voting 5 to 4 in Pottawatomie County v. Earls, the court ruled to allow random drug tests for all middle and high school students participating in competitive extracurricular activities. The ruling greatly expanded the scope of school drug testing, which previously had been allowed only for student athletes.

Just because the U.S. Supreme Court said student drug testing for adolescents in competitive extracurricular activities is constitutional, does that mean it is legal in my city or state?

A school or school district that is interested in adopting a student drug testing program should seek legal expertise so that it complies with all federal, state, and local laws. Individual state constitutions may dictate different legal thresholds for allowing student drug testing. The main purpose of random school drug testing is not to catch kids using drugs, it to keep them from ever using them. Once their using drugs its harder for them to break their addiction. With many employers drug testing its very important for a kid’s future not to use drugs. Drug use is responsible for many crimes. Its worth the inconvenience for all our future.

CON 2

One of the fundamental features of our legal system is that we are presumed innocent of any wrongdoing unless and until the government proves otherwise. Random drug testing of student athletes turns this presumption on its head, telling students that we assume they are using drugs until they prove to the contrary with a urine sample.

“If school officials have reason to believe that a particular student is using drugs, they already have the power to require that student to submit to a drug test,” said ACLU-NJ Staff Attorney David Rocah.

The constitutional prohibition against “unreasonable” searches also embodies the principle that merely belonging to a certain group is not a sufficient reason for a search, even if many members of that group are suspected of illegal activity. Peer pressure is the greatest cause of kids trying drugs. If by testing the athletes or other school leaders, we can get them  to say no to drugs, it will be easier for other kids to say no.

Some also argue that students who aren’t doing anything wrong have nothing to fear. This ignores the fact that what they fear is not getting caught, but the loss of dignity and trust that the drug test represents. And we should all be afraid of government officials who believe that a righteous cause warrants setting aside bedrock constitutional protections. Do ‘grown-ups’ have to be reminded to keep their clothes on in public? Apparently so

Here’s today’s COMMENT FROM AN OLD FART: Moi had to look twice at this notice from CBS to those attending the GRAMMY show, Breasts, buttocks banned by CBS from Grammys:

NEW YORK (AP) — CBS is asking stars not to bare too much skin at the Grammy Awards on Sunday.

The network requests that “buttocks and female breasts are adequately covered” for the televised award show. The memo sent out Wednesday also warned against “see-through clothing,” exposure of “the genital region” and said that “thong type costumes are problematic.”

Representatives for CBS and the Recording Academy declined to comment on Thursday. Deadline Hollywood first reported the memo.

One of the hallmarks of a generation or a cohort are attitudes which were formed by the period of time in which the generation or cohort existed. Perhaps, the best capsule to explain the attitude differences between the early days of the women’s movement and the sex is one way to climb the ladder of success ethos of the Sex in the City crowd is in the Dolly Parton movie, 9 to 5 which was released in 1980. It is interesting to read the NOW 1966 Statement of Purpose which states principles such as:

WE BELIEVE that it is as essential for every girl to be educated to her full potential of human ability as it is for every boy — with the knowledge that such education is the key to effective participation in today’s economy and that, for a girl as for a boy, education can only be serious where there is expectation that it will be used in society. We believe that American educators are capable of devising means of imparting such expectations to girl students. Moreover, we consider the decline in the proportion of women receiving higher and professional education to be evidence of discrimination. This discrimination may take the form of quotas against the admission of women to colleges, and professional schools; lack of encouragement by parents, counselors and educators; denial of loans or fellowships; or the traditional or arbitrary procedures in graduate and professional training geared in terms of men, which inadvertently discriminate against women. We believe that the same serious attention must be given to high school dropouts who are girls as to boys.

The naive little idea which NOW was enunciating at the time that was that women should get educated and gain experience so that they would be qualified on their merits for promotion. Women’s ENews has an article about the casting couch syndrome which the movie 9 to 5 highlighted and the early women’s movement fought so hard to overcome. In the article Sexual Harassment  Sandra Kobrin correctly takes the likes of Polanski and Letterman to task.

Marc D. Hauser writes in the Education Week commentary, Don’t Run Away From Teaching Pop Culture:

Check out the music children listen to, and you will hear rap and hip-hop songs about sex, violence, women as objects, and domination. Sometimes the questionable language is explicit and sometimes it’s implicit, veiled in metaphors. Ask children if the content is appropriate or what the song is about, and you will get one of four answers:

“I don’t know. I just like the music.”

“I don’t know, but it’s OK because it doesn’t have any swears in it.”

“I know it has cursing in it so I listen to the ‘clean’ version.”

“I know it’s about sex and violence, but I like the beat.”

When children think that music is inappropriate, most often they believe that the moral infraction lies with the use of profanity. If you clean up the words, you cleanse the moral space and thus are free to listen, they believe. In fact, YouTube is littered with tunes that are designated “clean” because censors have “bleeped out” the swearing in them. But that really isn’t good enough.

There are two problems with editing out profanity and acting as if a song is subsequently appropriate for all listeners. First, it doesn’t take a genius to figure out what words have been papered over and then mentally fill them in as the song goes by. Second, I think it is fair to assume that most parents and educators are far more worried about the larger meaning of a song—its message—than we are about a few bad words….

The bottom line is that educators (and parents) can’t run away from these issues, and we certainly can’t keep the material from children unless we believe that a life without radio and the Internet is possible; similar issues arise with books and movies, including many of the topics covered within the Twilight and Hunger Games series….

Although these issues are critical for parents, I’m going to focus here on what educators can, and I believe should, do to address this matter.

“Teachers should actively engage their students in discussions about the controversial material bombarding them.”

First, we must recognize that our students are surrounded by material that is, in many ways, not only age-inappropriate, but in some cases, morally inappropriate. Although what counts as morally inappropriate is certainly debatable, I would hope that most educators might agree on some topics, such as the barrage of rap songs that demean women or seem to promote violence as cool and exciting.

Second, we cannot sit back and let our students passively digest this material. No, instead, teachers should actively engage their students in discussions about the controversial material bombarding them.

More concretely, it should be a priority of all schools to develop classes around the lyrics in present-day music and to fully engage with the fiction that many of our children seek out. Literature classes provide a natural home for these topics; after all, great literature addresses moral challenges. Think Anna Karenina, Adam Bede, David Copperfield. So why not do the same for the song lyrics and for many of the most popular works of fiction on the market now? The American Psychological Association has written a report Sexualization of Girls and the Executive Summary contains the following definition:

There are several components to sexualization, and these set it apart from healthy sexuality. Sexualization occurs when

  • a person’s value comes only from his or her sexual appeal or behavior, to the exclusion of other characteristics;
  • a person is held to a standard that equates physical attractiveness (narrowly defined) with being sexy;
  • a person is sexually objectified—that is, made into a thing for others’ sexual use, rather than seen as a person with the capacity for independent action and decision making; and/or
  • sexuality is inappropriately imposed upon a person.

All four conditions need not be present; any one is an indication of sexualization. The fourth condition (the inappropriate imposition of sexuality) is especially relevant to children. Anyone (girls, boys, men, women) can be sexualized. But when children are imbued with adult sexuality, it is often imposed upon them rather than chosen by them. This society is setting up women and girls to make some personally destructive choices which have nothing to do with a liberating and healthy sexuality. Much of the culture is simply aimed at demeaning and trivializing women. Children of both sexes need to be urged toward education, training, and life experiences which grow them as responsible and caring people. They should be urged to make choices which benefit them and the society in which they live. Unfortunately, there are some who enter the world of whoredom because they are forced. There is a lot of information about human trafficking No one in their right mind would honestly advocate that someone they care about was “in the life” or “on the game.” But if young women are going to voluntarily take the road of whoredom, then you need to sell yourselves for Goldman Sachs type $$$$$$$$$$. That is what Miley, Britney, Janet and the other pop tarts have done. Short of that, you might as well be walking the streets looking for a really nice car that isn’t leased so that you can become the next “Pretty Woman.”

Martin Luther King, Jr. and the Constitution: Like what would Jesus do, folk wonder what would Martin do?

Here’s today’s COMMENT FROM AN OLD FART: There are a group of Christians whose reflex actions to a host of contemporary issues is to ask the question what would Jesus do? The answer is contained by reading the Bible, it’s in there. Similarly, folk of all persuasions like to play the what would Martin Luther King, Jr. do or think. Conservatives like to quote the “I have a Dream” speech for evidence that there should be a “color-blind” society. Moi guesses “liberals” are calling themselves “progressives” or maybe they are still “liberals” like to quote anything from Dr. King which advances their agenda. People change, grow, and often modify their views or time. The best indicator of what a person was thinking is what they left behind in terms of conversations particularly if their life was ended too soon. Moi read this self-serving pronouncement from a group of church folk, which was reported in the Seattle PI.com article, Pro-gun protest ‘shockingly insensitive’ — area clergy:

Seattle religious leaders have drawn up a letter, with 201 signatures as of early Friday, decrying as “shockingly insensitive” a pro-gun rally scheduled at “high noon” Saturday in Olympia, during the weekend of the national holiday honoring assassinated civil rights leader Martin Luther King Jr.

The letter will be released on Friday morning.

“We find it shockingly insensitive to Dr. King’s message, and contemptuous of his legacy, to celebrate the very instrument of his assassination during a holiday weekend dedicated to his memory,” said a draft of the clergy statement.  “The way to honor Dr. King’s memory is to condemn violence and to oppose any and all racial hatred, and we call on gun rights activists to join us in doing this rather than in focusing on the very means of Dr. King’s murder.” http://blog.seattlepi.com/seattlepolitics/2013/01/17/pro-gun-protest-shockingly-insensitive-area-clergy/

Moi understands that many in the faith community do not like guns because their abhor violence, but shockingly insensitive? Really folks, you need thicker skin to exist in a world where oil worker hostages get blown up.

So, let’s play that game what would Dr. King do or think when confronted with a group exercising their FIRST AMENDMENT rights? If one reads the actual text of Dr. King’s “I Have A Dream Speech” one is struck by the references to the U.S. Constitution, a document which he put his faith in to bring equality to those disenfranchised. Here is a portion of that speech:

I am happy to join with you today in what will go down in history as the greatest demonstration for freedom in the history of our nation.

Five score years ago, a great American, in whose symbolic shadow we stand today, signed the Emancipation Proclamation. This momentous decree came as a great beacon light of hope to millions of Negro slaves who had been seared in the flames of withering injustice. It came as a joyous daybreak to end the long night of their captivity.

But one hundred years later, the Negro still is not free. One hundred years later, the life of the Negro is still sadly crippled by the manacles of segregation and the chains of discrimination. One hundred years later, the Negro lives on a lonely island of poverty in the midst of a vast ocean of material prosperity. One hundred years later, the Negro is still languishing in the corners of American society and finds himself an exile in his own land. So we have come here today to dramatize a shameful condition.

In a sense we have come to our nation’s capital to cash a check. When the architects of our republic wrote the magnificent words of the Constitution and the Declaration of Independence, they were signing a promissory note to which every American was to fall heir. Piers Morgan refers to the U.S. Constitution as “that little book.” Well, that little book is a bit like the Bible. Folk like to pick and choose passages from the Bible that suit their purpose and discard portions that they don’t like. Most Bible scholars agree on rules of construction for how the Bible is to be read and interpreted. So it is with the U.S. Constitution. One cannot discard the FIRST AMENDMENT or the SECOND AMENDMENT because one finds them or people who exercise their rights under the Constitution “shockingly insensitive.” The Constitution guarantees ,like the Grace of God protect the good, the bad, and the indifferent.

Too bad those who are asking what would Dr. King do, don’t have the same faith in the U.S. Constitution that Dr. King did.

GAO report: Children’s mental health services are lacking

Both the culture and the economy are experiencing turmoil. For some communities, the unsettled environment is a new phenomenon, for other communities, children have been stressed for generations. According to the article, Understanding Depression which was posted at the Kids Health site:

Depression is the most common mental health problem in the United States. Each year it affects 17 million people of all age groups, races, and economic backgrounds.

Schools are developing strategies to deal with troubled kids….

One strategy in helping children to succeed is to recognize and treat depression.

How Common Is Depression In Children?      

According to Mary H. Sarafolean, PhD in the article, Depression In School Age Children and Adolescents

In general, depression affects a person’s physical,  cognitive, emotional/affective, and motivational well-being, no matter  their age. For example, a child with depression between the ages of 6 and 12 may exhibit fatigue, difficulty with schoolwork, apathy and/or a lack of motivation. An adolescent or teen may be oversleeping, socially isolated, acting out in self-destructive ways and/or have a sense of hopelessness.

Prevalence and Risk Factors

While only 2 percent of pre-teen school-age children and 3-5 percent of teenagers have clinical depression, it is the most common diagnosis of children in a clinical setting (40-50 percent of diagnoses). The lifetime risk  of depression in females is 10-25 percent and in males, 5-12 percent. Children and teens who are considered at high risk for depression disorders include:

* children referred to a mental health provider for school problems
* children with medical problems
* gay and lesbian adolescents
* rural vs. urban adolescents
* incarcerated adolescents
* pregnant adolescents
* children with a family history of depression    

If you or your child has one or more of the risk factors and your child is exhibiting symptoms of prolonged sadness, it might be wise to have your child evaluated for depression. 

How to Recognize Depression In Your Child?

Signs and symptoms of depression in children include:       

* Irritability or anger
* Continuous feelings of sadness, hopelessness
* Social withdrawal
* Increased sensitivity to rejection
* Changes in appetite — either increased or decreased
* Changes in sleep — sleeplessness or excessive sleep
* Vocal outbursts or crying
* Difficulty concentrating
* Fatigue and low energy
* Physical complaints (such as stomachaches, headaches) that do not respond to
treatment
* Reduced  ability to function during events and activities at home or with friends, in school, extracurricular activities, and in other hobbies or  interests

* Feelings of worthlessness or guilt
* Impaired thinking or concentration
* Thoughts of death or suicide        

Not all children have all of these symptoms. In fact, most will  display different symptoms at different times and in different settings.  Although some children may continue to function reasonably well in  structured environments, most kids with significant depression will  suffer a noticeable change in social activities, loss of interest in  school and poor academic performance, or a change in appearance.  Children may also begin using drugs or alcohol,
especially if they are  over the age of 12.

Joy Resmovits reported in the article, Mental Health Care For Kids Severely Lacking, Says GAO which was posted at Huffington Post:

“Most children whose emotions or behavior, as reported by their parent or guardian, indicated a potential need for a mental health service did not receive any services within the same year,” the GAO wrote.

The report comes after Sen. Tom Harkin (D-Iowa), Rep. Rosa DeLauro (Conn.), and Rep. Lucille Roybal-Allard (Calif.) requested that the GAO look into how psychotropic drugs affect the long-term development of kids who grow up in foster care. While the report is very specific in its scope, it’s sure to be a relevant piece of evidence as the Obama administration formulates policy to deal with the ramifications of the Newtown, Conn. elementary school shooting. The shooting has sparked a nationwide debate on gun control, but it has also directed America’s attention to the state of its mental health care system.

Here are some findings:

  • On average, 6.2 percent of noninstitutionalized children in Medicaid and 4.8 percent of privately insured kids received psychotropic medications.

  • 30 percent of foster children who might have required mental health care didn’t receive them over the last year.

  • Most kids outside the foster care system whose behavior displayed red flags didn’t receive mental care services.

  • Many kids who got psychotropic medication didn’t get counseling or therapy to complete the care.

What GAO Found

An annual average of 6.2 percent of noninstitutionalized children in Medicaid nationwide and 4.8 percent of privately insured children took one or more psychotropic medications, according to GAO’s analysis of 2007-2009 data from the Department of Health and Human Services’ (HHS) Medical Expenditure Panel Survey (MEPS). MEPS data also showed that children in Medicaid took antipsychotic medications (a type of psychotropic medication that can help some children but has a risk of serious side effects) at a relatively low rate–1.3 percent of children–but that the rate for children in Medicaid was over twice the rate for privately insured children, which was 0.5 percent. In addition, MEPS data showed that most children whose emotions or behavior, as reported by their parent or guardian, indicated a potential need for a mental health service did not receive any services within the same year. The Centers for Medicare & Medicaid Services (CMS) and many states have initiatives under way to help ensure that children receive appropriate mental health treatments. However, CMS’s ability to monitor children’s receipt of mental health services is limited because CMS does not collect information from states on whether children in Medicaid have received services for which they were referred. GAO recommended in 2011 that CMS identify options for collecting such data from state Medicaid programs. Findings in this report underscore the continued importance of CMS’s monitoring of children’s receipt of mental health services.

HHS’s Administration for Children and Families (ACF) reported that 18 percent of foster children were taking psychotropic medications at the time they were surveyed, although utilization varied widely by the child’s living arrangement. ACF also reported that 30 percent of foster children who may have needed mental health services did not receive them in the previous 12 months. HHS agencies are taking steps to promote appropriate mental health treatments for foster children, such as by sending information to states on psychotropic medication oversight practices.

HHS’s National Institutes of Health spent an estimated $1.2 billion on over 1,200 children’s mental health research projects during fiscal years 2008 through 2011. Most of the funding–$956 million–was awarded by the National Institute of Mental Health, with more research projects studying psychosocial therapies than psychotropic medications. Other HHS agencies spent about $16 million combined on children’s mental health research during this period.

HHS reviewed a draft of this report and provided technical comments, which GAO incorporated as appropriate.

Why GAO Did This Study

Experts have concerns that children with mental health conditions do not always receive appropriate treatment, including concerns about appropriate use of psychotropic medications (which affect mood, thought, or behavior) and about access to psychosocial therapies (sessions with a mental health provider). These concerns may be compounded for low-income children in Medicaid and children in foster care (most of whom are covered by Medicaid)–populations who may be at higher risk of mental health conditions. Within HHS, CMS oversees Medicaid, and ACF supports state child welfare agencies that coordinate health care for foster children.

GAO was asked to provide information on children’s mental health. This report examines (1) the use of psychotropic medications and other mental health services for children in Medicaid nationwide, and related CMS initiatives; (2) HHS information on the use of psychotropic medications and other mental health services for children in foster care nationwide, and related HHS initiatives; and (3) the amount HHS has invested in research on children’s mental health.

GAO analyzed data from HHS’s MEPS –a national household survey on use of medical services–from 2007 through 2009 for children covered by Medicaid and private insurance. GAO reviewed two recent ACF foster care reports with data from a national survey conducted during 2008 through 2011. GAO analyzed data from HHS agencies that conduct or fund research and interviewed HHS officials and children’s mental health providers, researchers, and advocates.

Celebrate diversity: Can people of color, women, and gays be racist and/or bigots?

Here’s today’s COMMENT FROM AN OLD FART: Jamie Foxx made a joke on SNL about “killing all the white people.” Madeline Morgenstern reports at the Blaze in the post, Jamie Foxx: Hollywood Deserves Some Blame for Violence (After Joking About Killing ‘All the White People’ Last Week):

Hollywood star Jamie Foxx said the movie industry deserves some of the blame for people who go out and commit violent acts

Foxx, promoting Quentin Tarantino’s upcoming “Django Unchained,” an ultra-violent Western-style vengeance film about slavery, told the Associated Press that actors can’t ignore that the violence they portray onscreen can influence people in real life.

“We cannot turn our back and say that violence in films or anything that we do doesn’t have a sort of influence,” Foxx said Saturday. “It does.”

Foxx’s comments came in the wake of Friday’s mass elementary school shooting, where a gunman shot and killed 20 children and six adults before committing suicide.

Now, a white person making a joke about killing all people of color and gays, not only would never eat lunch in this town again, they would probably not work again, either.

Politico reports in the article, Charlie Rangel hits Obama on diversity:

Barack Obama is facing charges that his White House lacks diversity.

“It’s embarrassing as hell. We’ve been through all of this with [2012 GOP presidential nominee] Mitt Romney. And we were very hard with Mitt Romney with the women binder and a variety of things,” Rangel said on MSNBC. “And I kind of think there’s no excuse with the second term.”

The Obama administration has been criticized recently for not having enough diversity with its Cabinet appointees after The New York Times ran a photo of Obama meeting with senior advisers in the Oval Office, the vast majority of them white men. One could rest assured that had Governor Romney won the presidency, there would be mass marches outside the White House had Rep. Rangel called him out on diversity.

So, what’s going on here? Is it situational ethics rather than looking at principles which are enduring and apply to all? The theory as to why some believe that people of color, women, and gays cannot be racists is that they are oppressed? Really, are Oprah, Hillary Clinton, or Elton John oppressed? What the theorists want to assert is that if there has been a history of wrongdoing, that wrongdoing is eternal and can never be eradicated. If one is a member of a group who has suffered oppression mere membership in the group is enough to stamp your eternal oppression card.

Moi is not suggesting that the U.S. is a “post-racial society” where race, sex or sexual orientation does not matter, it does. Still, to suggest that people of color, women, and gays cannot be bigots and racists is ludicrous. Individual members of any group can be racists and bigots and individuals from any group can collectively join to be racists and bigots.

The principle in society should be that no one gets a pass for racist and bigoted behavior and the time of stamping eternal oppression cards must end.

Both sides in the gun debate are acting like morons

Here’s today’s COMMENT FROM AN OLD FART: The U.S. Constitution is a bit like the Bible. People want to select passage from both documents which suit their purpose and their intent. People don’t want to deal with the parts that they don’t agree with or that they find disagreeable.

Slate published this interesting 2001article, What Does the Second Amendment Say About  the Right To Own Guns?

State law and state constitutions may change, but the progress of Second Amendment jurisprudence is glacial. As a matter of pure legal precedent, the Justice Department likely has the winning argument in this debate simply because the last time the U.S. Supreme Court ruled on this point was in 1939. In United States v. Miller, the court held that the Second Amendment right to keep and bear arms is not applicable in the absence of a reasonable relationship to the “well regulated militia” provision of the Second Amendment. The court stated that:

In the absence of any evidence tending to show that possession or use of a “shotgun having a barrel of less than eighteen inches in length” at this time has some reasonable relationship to the preservation or efficiency of a well regulated militia, we cannot say that the Second Amendment guarantees the right to keep and bear such an instrument.

The Supreme Court has turned down every opportunity to accept a new case and clarify the question of whether Miller established a definitive test requiring some connection between guns and state militias or whether it was announcing a one-time-only rule about Jack Miller and his shotgun. Still, the lower courts have followed the first view, and, in the wake of Miller, virtually every lower court has accepted the state militia/collective rights test as a settled point of law. While a fascinating normative debate over whether or not the right should be an individual one rages in the academy, in think tanks, and around the candy machines at NRA headquarters, the Second Amendment issue is not a close call in the courthouse. Eminent legal scholars, including Sanford Levinson and historians such as Emory’s Michael Bellesiles, have done some staggering scholarly work on the subject of the original intent of the Framers and the prevalence of guns at the time of the founding of the country. [Updated May 8, 2002: Bellesiles’ methodology has recently come under fire by constitutional scholars.] None of it has induced the Supreme Court to step into the fray.

The modern Supreme Court has invalidated federal gun laws, most recently in United States v. Lopez, but not on Second Amendment grounds. Nothing about the decision in Lopez reinforces an individual’s right to bear arms; it merely curbs congressional attempts to regulate guns, which is by no means the same thing.

Why do opinion surveys show that most American citizens believe in the individual rights position? Some legal scholars call this widespread public conviction a “hoax” and “false consciousness.” Some contend that the NRA has done a spectacular job of spinning an individual right out of law review articles, John Wayne movies, and effective propaganda. There are many proposals for “rational” gun control.

Although I would personally like to see as many civilian-owned guns eliminated from mainstream society as possible, I realize that this is not a politically realistic goal. Thus, I present my own plans for gun control that I would consider a valid compromise. Perhaps policy discussions can start from these.

1. A national system for registering guns and ammunition. Part of the reason New York City has stiff gun laws and high gun death rates is that anybody can go from New York to a state with less restrictive laws, get a friend who lives in the state to buy the guns for them, and take those guns back to NYC. (Yes, I am aware this is illegal, but it happens.) First, a national system would prevent this by scaring those “friends” into not buying the guns legally and selling them illegally, for if the guns are used in an illegal crime, that person can be held accountable. Second, a national system would be more helpful in tracking crimes after they have happened, to bring the perpetrators to justice.

2. Instant background checks on people attempting to buy guns or ammunition. Brady is still patchwork, and does indeed have its flaws in tracking felons. Felons and ex-cons should not have access to weapons, and many misdemeanors and juvenile crimes should also count against a person’s record.

3. Stiffer sentences for gun crimes. This has been the position of the NRA for quite some time, and it is certainly one with which I agree.

4. Gun education. Many guns are involved in accidents that could easily have been prevented by a little care or forethought. Perhaps gun purchasers should be required to take lessons in gun safety, at the purchaser’s expense. Again, the NRA has long been a proponent of gun education.

5. General education. Study after study has concluded that there is a direct correlation between lack of education and violent crime. Every dollar spent on education now will prevent countless dollars worth of crime damage in the future. Think of all the private and public funds used to pay for gun violence — hospital bills, funerals, insurance bills, the actual cost of buying firearms. Now invest that money in education, and watch the crime rate drop.

6. Hand grip ID tagging. This is technologically probably still in the future, but it would be a good goal to work for. The theory is, each gun is “registered” to one’s person palm prints (the legal purchaser of the gun), and only that person can fire that gun. If another person tries, the gun simply will not fire. Thus, stolen guns become useless, and cannot be used to harm anybody in the course of a crime.   http://www.asahi-net.or.jp/~zj5j-gttl/guns.htm

What both proponents of gun control and those who advocate unfettered gun possession along with unlimited possession of ALL types of guns don’t want to acknowledge is that it ultimately goes back to the Constitutional process of a legislature enacting a law and the judiciary reviewing the Constitutionality of the law. Neither side may be happy with the result.

Very bad things do happen to very good people

Here’s today’s COMMENT FROM AN OLD FART: Times of trial try the faith of the believer. Christina Ng of Good Morning America reports in the article, Priest’s ‘Horrible’ Job Telling Parents of Children’s Deaths:

A Newtown, Conn., priest had the “horrible” job of informing families this morning that their children had been killed in the elementary school massacre.

There were 20 children among the 27 people brutally killed the day Adam Lanza, 20, invaded Sandy Hook Elementary School and opened fire on staff and students. Lanza was also found dead in the school.

Medical examiners have completed the grim work of identifying all of the victims at the school and families were informed early this morning that their loved ones had been killed.

“We were gathered until after midnight and we were sent out with teams to go to the homes of the victims,” parish priest Monsignor Robert Weiss told “Good Morning America” today. “We went to their homes early this morning to confirm the death of their children and it was just horrible.” http://gma.yahoo.com/priests-horrible-job-telling-parents-childrens-deaths-165442686–abc-news-topstories.html

It could have been a priest, it could have been a rabbi, it could have been a minister or the head of a Buddhist, Hindu, Muslim or Sikh temple. It could have been some person of no faith who would see the Sandy Hook massacre as one more reason not to believe. It is at times when one tries to fathom the death of children with reasons known only to the tortured soul of the killer that folks first ask why and then go on to what it is they believe.

REM poses the question for many in their ditty “Losing My Religion”

Oh life, it’s bigger
It’s bigger than you
And you are not me
The lengths that I will go to
The distance in your eyes
Oh no, I’ve said too much
I set it up

That’s me in the corner
That’s me in the spotlight
Losing my religion
Trying to keep a view
And I don’t know if I can do it
Oh no, I’ve said too much
I haven’t said enough….

Some of those who suffer unfathomable lose will indeed lose their religion, while other will find their faith. The answer depends on the question that they ask.

The question is an age old question which is why do bad things happen to good people? Job asked this very question of God. Rabbi Harold Kushner wrote the 1978 book When Bad Things Happen to Good People which attempted to explain why good people suffer.

Kushner outlines the various ways that people try to salvage their view of God and His orderly world. They explain that misfortune occurs because

  1. Someone made a mistake, or failed in the observance of some religious duty.
  2. God has a hidden purpose, or is making use of knowledge we don’t have.
  3. Suffering itself will turn out to be good for us.
  4. God’s purpose is in the grand design of the Universe (which is good and beautiful), not in the life of the individual.
  5. Suffering teaches something, either to us or to those who see us suffer.
  6. Suffering is a test.
  7. Death leads us and our loved ones to a better place.

Kushner rejects all of these explanations.

“All the responses to tragedy which we have considered have at least one thing in common. They all assume that God is the cause of our suffering, and they try to understand why God would want us to suffer. … There may be another approach. Maybe God does not cause our suffering. Modern society is loath to deal with the concept of evil, because evil cannot be treated with Prozac, or therapy, or meditation. It is simply easier to hold God responsible and walk away.

Over the next months and years many will be losing their religion and many others will find their faith. Because of the evil that exists in the world, some very bad things happen to some very good people.

Horrific Connecticut school shooting: Is posting the Ten Commandments at school really the problem?

Here’s today’s COMMENT FROM AN OLD FART: Today there was another horrific school shooting. AP reports in the article, AP: 27 Dead, Including 18 Children, At Sandy Hook School Shooting In Newtown:

Twenty-seven people, including 18 children, have been killed in a shooting at Sandy Hook Elementary School, according to the Associated Press.

The report cites an official with knowledge of the situation.that there are at least 20 shooting victims. Many of the shootings took place in a kindergarten classroom, sources said. Lane is charged with three counts of aggravated murder, two of attempted aggravated murder and one of felonious assault.

October 2, 2006 – West Nickel Mines School, Nickel Mines, Pennsylvania. Charles Roberts IV, 32, goes to the small Amish school and takes at least 11 girls hostage. Five girls were killed and six others wounded. Roberts then killed himself.

November 8, 2005 – Campbell County Comprehensive High School, Jacksboro, Tennessee. A 15-year-old student opens fire on a principal and two assistant principals, killing one of them and critically wounding another, authorities said.

March 21, 2005 – Red Lake High School, Red Lake, Minnesota. Jeff Weise, 16, kills his grandfather and another adult, four fellow students, a teacher and a security officer. He then killed himself.

March 5, 2001 – Santana High School, Santee, California. Charles “Andy” Williams, 15, kills two classmates, a 14-year old and a 17-year old, and injures 13. Williams is sentenced in 2002 to at least 50 years in prison.

April 20, 1999 — Columbine High School, Littleton, Colorado. Eric Harris, 18, and Dylan Klebold, 17, kill 12 fellow students and one teacher before committing suicide in the school library.

May 21, 1998 – Thurston High School, Springfield, Oregon. After killing his parents the previous day, 15-year old Kip Kinkel returns to Thurston High armed with a rifle. He kills two students in the school cafeteria, a 16- and a 17-year old. He is sentenced to 112 years in prison.

March 24, 1998 – Westside Middle School, Jonesboro, Arkansas. Andrew Golden, 11, and Mitchell Johnson, 13, ambush fellow students and their teachers, killing five. Johnson is incarcerated in a youth facility and released on his 21st birthday in August 2005. Golden is released on his 21st birthday in May 2007.

December 1, 1997 – Heath High School, West Paducah, Kentucky. Michael Carneal, 14, opens fire on a school prayer group, killing three girls. He is serving life in prison.

February 2, 1996 –– Frontier Junior High School, Moses Lake, Washington. Barry Loukaitis, 14, takes a rifle to school and kills two classmates and a teacher. He was sentenced to life in prison.

In the majority of cases considering official posting of the Ten Commandments, the Court has extended this prohibition. In its 1980 (Stone v. Graham) decision striking down a Kentucky law requiring that a copy of the Ten Commandments be posted in every public school classroom, the Court said:

The pre-eminent purpose for posting the Ten Commandments on schoolroom walls is plainly religious in nature. The Ten Commandments are undeniably a sacred text in the Jewish and Christian faiths, and no legislative recitation of a supposed secular purpose can blind us to that fact. The Commandments do not confine themselves to arguably secular matters, such as honoring one’s parents, killing or murder, adultery, stealing, false witness, and covetousness. Rather, the first part of the Commandments concerns the religious duties of believers: worshipping the Lord God alone, avoiding idolatry, not using the Lord’s name in vain, and observing the Sabbath Day.

The Court recently issued two decisions concerning official display of the Ten Commandments with differing results. In McCreary v. ACLU of Kentucky, the Court considered county courthouse displays of the Ten Commandments in Kentucky. Similar to the Stone decision, it again recognized that the Ten Commandments is “… an unmistakably religious statement dealing with religious obligations and with morality subject to religious sanction.” The Court ultimately decided that the displays were unconstitutional because their history and context demonstrated a clear religious purpose and intent on the part of county officials.

In Van Orden v. Perry, the Court considered a forty-year-old granite Ten Commandments monument on the Texas capitol grounds – one of seventeen monuments on the broad plaza. Reaching an opposite result, the Court decided that this display is constitutionally permissible. However, Justice Breyer, who cast the deciding vote in the case, characterized the display as “borderline” and found that it served “a mixed but primarily nonreligious purpose.” Significantly, as with the McCreary decision, a majority of the Justices indicated that displays in public schools likely will be unconstitutional. There are pros and cons of posting the Ten Commandments or any other statement of values.

The blog TresSugar posted a good summary of the pros and cons of posting the Ten Commandments:

PRO 1

Our government was based on religious principles from the very beginning. The 10 Commandments are the foundation of our moral government.

CON 1.1

Having religious principles does not mean that they wanted to use the government to force religion on the country. The ratification of the constitution by the states was held up because it didn’t have a written list of basic rights that couldn’t be taken away. The very first line in the Bill of Rights reads “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof”. After these were assured only then was the constitution ratified.

PRO 2

Since the court outlawed prayer, the nation has been in steady moral decline. Former Secretary of Education William Bennett revealed in his cultural indexes that between 1960 and 1990 there was a steady moral decline. During this period divorce double, teenage pregnancy went up 200%, teen suicide increased 300%, child abuse reached an all-time high, violent crime went up 500% and abortion increased 1000%. There is a strong correlation between the expulsion of prayer from our schools and the decline in morality.

CON 2.1

If you go back the other way in time, do you find higher morals in slavery, or our treatment of Indians, or more recently, Jim Crow laws in the South, or official discrimination against women or children being used as cheap labor?

CON 2.2

The Census Bureau reports that 63 percent of the population claims church membership, a figure that has remained virtually unchanged since the 1960 census.

CON 3

The BILL OF RIGHTS was designed to protect the minorities basic rights from the majority. In the case of religion “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof”. It says its against the constitution to prohibit free exercise of religion. Free is a key word here, state supported religion is not “FREE EXERCISE” its “FORCED RELIGION” and that is prohibited.

PRO 4

Rep. Bob Barr, R-Ga., a cheerleader for the measure, reportedly said that if the Ten Commandments had been posted at Columbine, the shootings would never have taken place.

CON 4.1

The boy who shot six of his fellow students in Barr’s home state of Georgia had attended a church service the night before.

CON 5

The book of EXODUS has two completely different versions of the 10 Commandments. EXODUS 20 and EXODUS 34. One Commandment that is common to both versions is keeping the Sabbath. In EXODUS 35 Moses tells the people that those who break the Sabbath, even lighting a fire in their homes, should be put to death. Will this Commandment teach our kids about ignoring inconvenient rules?

PRO 6

All that we would like to do is give the kids a foundation for moral behavior. This is not an evil conspiracy, its an attempt to make things better and safer for all kids.

CON 7

“This is about the government playing favorites and saying Judaism and Christianity are the appropriate religions and everyone else is wrong,” explains Peter Eliasberg, an ACLU attorney. “That’s not moral guidance, it’s dividing the people on the basis of religion.”

CON 8

In the attempt to eradicate all vestiges of religion from the public square, this society has thrown out a good deal of the values and moral principles which are the glue that holds a society together. Note the time line of school shootings after the 1980 Stone v. Graham case. Values education in schools should be a part of the curriculum.

The education opportunity divide: Parents face jail for wanting a better life for their child

Many “progressives” want to put forth the idea that families don’t matter, particularly in low-income communities of color. It is a different story in middle and upper income “progressive” families as they “helicopter parent “their children. Rosa Duarte of WFMZ69 News is reporting Parents face felony charges for sending daughter outside their district:

A Philadelphia couple is facing felony charges after allegedly lying about where they lived in order to send their daughter to a school outside their district.

Hamlet and Olesia Garcia were charged in August of this year with “theft of services”, a 3rd degree felony punishable by up to 7 years in prison, by the Lower Moreland School District in Montgomery County.

The Garcias are accused of sending their daughter to the district even though they didn’t pay property taxes, according to the District Attorney’s office. The couple cost tax payers $10,752.81.

Thursday, civil rights activists along with lawmakers held a press conference saying the laws and the ways Pennsylvania public schools are funded are unfair.

The District Attorney should go after real criminals and not put parents in prison facing up to seven years and be registered as felons because they allegedly stole a quality education,” said former California State Senator Gloria Romero.

Romero introduced the nation’s first ‘Parent trigger’ law in 2008, which allows parents of a failing school district to vote on a method to restructure the school, mostly by transforming it into a charter school….

According to Bethlehem Area School Superintendent, Joseph Roy, stories like the Garcias’ are a symptom of a much bigger matter.

This issue of inequities and funding has been going on for years and there have been different efforts to try to adjust it but never to full satisfaction,” said Roy.

As for a solution, those involved like the Garcias’ attorney Thomas Kenny said it’s up to legislators, “I would very much like the laws in the commonwealth to change and I hope today is the start of that process happening,” he said.

The Garcias’ case is the beginning of many because education equity is the next great civil rights struggle.

Plessy v. Ferguson established the principle of “separate but equal” in race issues. Brown v.Board of Education which overturned the principle of “separate but equal.” would not have been necessary, but for Plessy. See also, the history of Brown v. Board of Education

If one believes that all children, regardless of that child’s status have a right to a good basic education and that society must fund and implement policies, which support this principle. Then, one must discuss the issue of equity in education. Because of the segregation, which resulted after Plessy, most folks focus their analysis of Brown almost solely on race. The issue of equity was just as important. The equity issue was explained in terms of unequal resources and unequal access to education.

People tend to cluster in neighborhoods based upon class as much as race. Good teachers tend to gravitate toward neighborhoods where they are paid well and students come from families who mirror their personal backgrounds and values. Good teachers make a difference in a child’s life. One of the difficulties in busing to achieve equity in education is that neighborhoods tend to be segregated by class as well as race. People often make sacrifices to move into neighborhoods they perceive mirror their values. That is why there must be good schools in all segments of the city and there must be good schools in all parts of this state. A good education should not depend upon one’s class or status.

I know that the lawyers in Brown were told that lawsuits were futile and that the legislatures would address the issue of segregation eventually when the public was ready. Meanwhile, several generations of African Americans waited for people to come around and say the Constitution applied to us as well. Generations of African Americans suffered in inferior schools. This state cannot sacrifice the lives of children by not addressing the issue of equity in school funding in a timely manner.

The next huge case, like Brown, will be about equity in education funding. It may not come this year or the next year. It, like Brown, may come several years after a Plessy. It will come. Generation lost: A future of low expectations

Nearly 6.5 million U.S. teens and young adults are neither in school nor working, according to a new report from the Annie E. Casey Foundation. The report warns of a future of chronic unemployment due to a continuing failure to educate and train America’s youth in needed skills.

The most recent “Kids Count” report, one of the most widely cited surveys of how youth fare in the United States, found that young people aged 16 to 24 are facing serious barriers to successful careers as youth unemployment has reached its highest level since World War II. Only about half of young people in that age group held jobs in 2011, according to the report, titled “Youth and Work: Restoring Teen and Young Adult Connections to Opportunity.”

The employment rate for teens between the ages of 16 and 19 has fallen 42 percent over the last decade: 2.2 million teens and 4.3 million young adults aged 20 to 24 are neither working nor in school. Of those without school or work, 21 percent — or 1.4 million — are young parents.

North Dakota, Nebraska and Minnesota had the highest rates of employment among 20- to 24-year-olds. Laura Speer, one report’s authors, told Minnesota Public Radio that early employment is key to future success.

“The thing that you got and I got from our very first job is mostly about how to work,” Speer said. “How to be on a team, how to have a boss, how to show up on time. And those — what are termed as ‘soft skills’ — are things that are really critically important going forward.”

Young adults are facing more competition from older workers for increasingly scarce entry-level jobs. Many lack the skill set required for available jobs. Still others face obstacles beyond their control, such as low-performing schools, a lack of working-adult role models and impoverished upbringings.

Child Fund and the Alliance have conducted a survey of children around the globe about their hopes. Huffington Post is reporting in the story, Child Fund Alliance Survey: Kids In Developing Countries Dream Of Better Education (SLIDESHOW):

To find out what kids around the world dream of when it comes to pursuing the best life they can imagine, the ChildFund Alliance surveyed 5,100 children throughout Africa, Asia, the Americas and the United States. The nonprofit, which works with vulnerable kids in 56 countries, asked privileged kids and children in need questions about their ideal jobs and how they would improve their countries as president.

J. Maureen Henderson has an interesting piece at Forbes, Careers Are Dead. Welcome To Your Low-Wage, Temp Work Future:

According to the Economic Policy Institute, almost 30% of American workers are expected to hold low-wage jobs – defined as earnings at or below the poverty line to support a family of four – in 2020. This number will remain virtually unchanged from 2010. Given that roughly 50% of recent college grads are unemployed or underemployed and those who do work are much more likely to hold these types of jobs, this is a particular grim prospect for young workers hoping to leave these positions behind for greener career pastures.

And even if Millennial workers do manage to move from retail to the corporate world, there’s no guarantee that their office job will be on the career track. The number of temporary or contract positions was up 6% over last year’s numbers in the first quarter of 2012 according to the American Staffing Association. In fact, the number of temporary or contract jobs added to the economy has been increasing for nine consecutive quarters since the recession officially ended. Over 40% more people hold temp jobs now than in 2009. This growth starts to become something to worry about when temp jobs aren’t being converted to permanent ones and when contract work replaces full-time positions. As ASA CEO Richard Wahlquist put it when discussing the numbers:

“Employers remain hesitant to add permanent employees due to uncertainty about the current strength of the economy and future economic conditions, including impending tax increases and spending cuts expected to take effect in January 2013. In times like these, businesses are being much more strategic in sourcing additional talent and maintaining work force flexibility.”

And this cautious approach to staffing and reliance on a disposable workforce may continue for years. While there are certainly highly-skilled and in-demand professionals who are able to parlay their hired-gun status into big paydays or renaissance workers who are mashing up day jobs and dream jobs, those who benefit financially from the gig economy are in the minority.
